ORDINANCE NO. 3606
AN ORDINANCE of the City of Pasco, Washington, Declaring a
Moratorium on the Acceptance of Applications for Preliminary Plat
Approval for Residential Development and Providing for a Hearing Thereon.
WHEREAS, the City issued building permits for more than 700 new homes in 2002, a
development pace at least three times the City's recent trend; and
WHEREAS, the City has recently received a petition submitted by citizens calling for a
moratorium due to concerns of over development, traffic congestion, loss of open spaces and
over crowded schools jeopardizing the quality of the neighborhoods in the City of Pasco; and
WHEREAS, the City is likewise facing the imposition of changed regulations affecting
disposal of the storm water and the injection of storm water into the aquifer, and
WHEREAS, there has been a request to address these and other development standards
to insure their consistencies, practical impact upon the future development costs, as well as
anticipated remediation costs, and the City's capacity to distribute and provide utility services;
and
WHEREAS, sufficient study is necessary to address these concerns prior to the further
development of residential neighborhoods within the City of Pasco; and
WHEREAS, RCW 35A.63.220 provides for the imposition of a moratorium to permit
the City to address these concerns and maintain the status quo; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN
AS FOLLOWS:
Section 1. The City Council hereby declares a moratorium on the acceptance of any
applications for preliminary plat approval of residential subdivisions within the City limits of the
City of Pasco, Washington, for a period of six (6) months from the date of this Ordinance, or
until the Council completes the adoption of necessary action, Ordinances, amendments or
Resolutions establishing the appropriate development standards for the development of
residential subdivisions and completes its study to determine that essential City services are
available to accommodate additional residential development.
Section 2. A public hearing shall beheld before the City Council on the moratorium
at 7:00 p.m., or as soon thereafter as may in the ordinary course of business be heard on March
17, 2003, or such other time as the hearing may be continued to, however, in no event shall such
hearing occur more than sixty (60) days after the date of the adoption of this Ordinance.
Following the public hearing, the City Council shall determine whether to continue the
moratorium for a period not to exceed six (6) months from the date of this Ordinance, or that the
moratorium be terminated. The City Council shall adopt Findings of Fact justifying its actions in
regards to the continuation of the moratorium.
Section 3. This is an emergency Ordinance and is necessary for the immediate
preservation of the public peace, health or safety, and shall take effect immediately upon
approval by a majority plus one of the whole membership of the Council."
PASSED by the City Council of the City of Pasco, Washington and approved as
provided by law this 18`h day of February, 2003.
