HomeMy WebLinkAbout3580 Ordinance ORDINANCE NO. 3580 AN ORDINANCE OF THE CITY OF PASCO, WASHINGTON, DISSOLVING THE JOINT HOUSING AUTHORITY OF THE CITY PASCO AND FRANKLIN COUNTY. WHEREAS, the City of Pasco, Washington, and Franklin County, pursuant to RCW 35.82.300 created a Joint Housing Authority by City Ordinance No. 2299 and County Ordinance No. 17-81; such Ordinances being adopted on September 8, 1981; and WHEREAS, said Ordinances provide that "This Joint Housing Authority may be operated in the City of Pasco and Franklin County until such time as the governing body of either the City of Pasco or Franklin County shall pass an Ordinance dissolving the same."; and WHEREAS, the City of Pasco has determined that more than 21 years since the enactment of this Ordinance, there have been no facilities of the joint housing authority constructed or operated outside of the City limits of the City of Pasco; and WHEREAS, the City has determined that there is little beneficial reason to continue the joint housing authority and to the contrary, additional benefits may be enjoyed by the City in maintaining a housing authority solely for the benefit of those residing within the City of Pasco and that a City housing authority may be empowered to perform additional functions including the preparation and administration of Community Renewal Plans and such other functions as are consistent with the goals and objectives of the City of Pasco; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. DISSOLUTION OF JOINT HOUSING AUTHORITY. The joint housing authority created by Ordinance No. 2299 known as "The Housing Authority of the City of Pasco and Franklin County" shall be and hereby is dissolved. The City of Pasco Ordinance No. 2299, together with its codification as Pasco Municipal Code Chapter 2.36 entitled "Joint Housing Authority" as of the effective date provided below, is repealed in its entirety. This repeal shall not revive any prior Ordinance dealing with this same subject. Section 2. EFFECTIVE DATE. The effective date of this repeal shall be February 1, 2003. Section 3. NOTICE TO COUNTY AND TO HOUSING AUTHORITY OF THE CITY OF PASCO AND FRANKLIN COUNTY. The City Clerk shall forthwith send to the Board of County Commissioners of Franklin County, Washington, and the Executive Director of the Housing Authority of the City of Pasco and Franklin County, a copy of this Ordinance as notice dissolving the joint housing authority effective February 1, 2003. This notice shall further restrict a joint housing authority from entering into any contract or incur liabilities that extend beyond February 1, 2003. Section 4. AUTHORIZATION OF THE CITY MANAGER. The City Manager is authorized and directed to prepare, execute, and have executed by the County, all documents necessary to segregate the interests of the City from that of the County, if any, and to facilitate the dissolution of the joint housing authority by the effective date provided above. The City Manager, or his designee, shall have full authority to exercise all powers necessary to continue the operation of those facilities of the joint housing authority which shall devolve back to the possession and control of the City as a result of this dissolution to the extent necessary. Further, to the extent necessary, the City Council of the City of Pasco may exercise any power granted to a housing authority under law until such time as a succeeding City housing authority or other public agency is organized to fulfill this function. Section 5. Subject to the effective date of the repeal provided in Section 2 above, this Ordinance shall take full force and effect five (5) days after its passage, approval and publication as required by law. Section fi. SEVERABILITY. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance.
