HomeMy WebLinkAbout3550 Ordinance ORDINANCE NO. 3550 AN ORDINANCE of the City of Pasco, Washington, Creating Section 13.60.130 "Storm Water Construction Permit Required" Requiring Storm Water Plans and Permits. WHEREAS, the City of Pasco operates and maintains a storm water system within its Urban Growth Area; and WHEREAS, in order to establish a State mandated storm water permitting process that is consistent with the site characteristics found within the Urban Growth Area of the City and to facilitate this permitting process; and WHEREAS, the City of Pasco has received the study commissioned to determine those areas to be considered as covered by the City's General Storm Water Permit as "pre-approved" as opposed to those areas subject to a site specific individual storm water permit requiring the submission of a storm water plan; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. That a new Section 13.60.130 entitled "Storm Water Construction Permit Required" to the Pasco Municipal Code shall be and hereby is created and shall read as follows: 13.60.130 STORM WATER CONSTRUCTION PERMIT REQUIRED. Prior to construction of any structure, grading or improvement upon real property located within any critical areas as designated in the City's Comprehensive Land Use Plan or within 200 feet of the high water mark of the Columbia River, a Storm Water Plan shall be submitted and upon approval, a Storm Water Construction Permit shall be issued upon payment of the Storm Water Construction Permit Fee as provided in the City Fee Summary Ordinance. Construction of any structure, grading or improvement upon real property not located within the critical areas or within 200 feet of the high water mark of the Columbia River, may not require submission of a Storm Water Plan or the issuance of a Storm Water Construction Permit unless required by the Director of Public Works, due to the unique characteristics of the premises which presents a threat of storm water runoff. Section 2. This Ordinance shall take full force and effect on January 1, 2003. PASSED by the City Council of the City of Pasco, Washington and approved as provided by law this 3`d day of June, 2002.
