AN ORDINANCE of the City of Pasco, Washington, Amending
the Zoning Classification of Certain Real Property Located in
Section 8, Township 9 North, Range 29 East, W.M., from RT
(Residential Transition) to R-1 (Low Density Residential) and R-3
(Medium Density Residential).
WHEREAS, a complete and adequate petition for change of zoning
classification has been received and an open record hearing having been
conducted by the Pasco Planning Commission upon such petition; and,
WHEREAS, that the effect of the requested change in zoning
classification shall not be materially detrimental to the immediate vicinity; and,
WHEREAS, there are conditions which should be imposed in order to
mitigate any potential significant adverse impacts from the requested change of
zoning classification on the surrounding vicinity justifying a Concomitant
Agreement including terms restricting certain land uses; and,
WHEREAS, based upon substantial evidence and demonstration of the
Petitioner, that: (A) the requested change for the zoning classification is
consistent with the adopted Comprehensive Plan; (B) the requested change in
zoning classification is consistent with or promotes the goals and objectives of
the Comprehensive Plan serving the general public interest in the community;
and (C) there has been a change in the neighborhood or community needs or
circumstances warranting the requested change of the zoning classification in
that utilities necessary to serve residential development on these properties
have now been designed and will be extended to the area and (D) the request
for change in zoning classification is categorically exempt under the
Washington State Environmental Policy Act; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO
ORDAIN AS FOLLOWS:
Section 1. That the Zoning Ordinance for the City of Pasco, Washington,
and the Zoning Map, accompanying and being part of said Ordinance shall be
and hereby is changed from RT (Residential Transition) to R-1 (Low Density
Residential) for the real property as shown in the Exhibit "1" attached hereto
and described as follows:
A parcel of land located in the northwest quarter of Section 8,
Township 9 North, Range 29 East, W.M., City of Pasco, Franklin
County, Washington, described as follows;

Beginning at a point on the east right of way line of Broadmoor
Boulevard and the northwest corner of Lot 7 of Binding Site Plan
#2001-03, as recorded in Volume 1, of Binding Site Plans, page 54,
per Auditor's file number 1592001, thence N00°57'22"E, along said
right of way, a distance of 526.00 feet to the True Point of
Beginning; thence S89°02'38"E, a distance of 2,597.43 feet to the
east line of Broadmoor Park No. 1, according to the official plat
thereof recorded in volume "D" of plats, page 28, records of said
County; thence N00°11'09"E, along said east line, a distance of
1,041.04 feet to the northeast corner of said plat; thence
N89°21'09"W, along the north line of said plat, a distance of
320.00 feet; thence N00°11'09"E, leaving said north line, a
distance of 30.00 feet to a point on the north line of the northwest
quarter of said Section 8; thence N89°21'09"W, along said
northwest quarter, a distance of 2,263.07 feet to the northwest
corner of said northwest quarter; thence S00°5722"W, along the
west line of said northwest quarter, a distance of 607.09 feet;
thence S89 002'38"E, leaving said west line, a distance of 210.00
feet; thence S00°5722"W, a distance of 200.00 feet; thence
N89°02'38"W, a distance of 210.00 feet to a point on said west line;
thence S00°5722"W, along said west line, a distance of 249.94 feet
to the True Point of Beginning.
Section 2. That the change of a zoning classification as provided in
Section 1 is contingent, and conditioned upon execution and compliance with a
Concomitant Agreement entered into between the Petitioner and the City which
will attach to and run with the real property described in Section 1 above. Said
Concomitant Agreement is attached to this Ordinance as Exhibit No. "2".
Section 3. That the Zoning Ordinance for the City of Pasco, Washington,
and the Zoning Map, accompanying and being part of said Ordinance shall be
and hereby is changed from RT (Residential Transition) to R-3 (Medium Density
Residential) for the real property as shown in the Exhibit "1" attached hereto
and described as follows:
A parcel of land located in the northwest quarter of Section 8,
Township 9 North, Range 29 East, W.M., City of Pasco, Franklin
County, Washington, described as follows;
Commencing at a point on the east right of way line of Broadmoor
Boulevard and the northwest corner of Lot 7 of Binding Site Plan
#2001-03, as recorded in Volume 1, of Binding Site Plans, page 54,
per Auditor's file number 1592001, thence S890 02' 38"E, along
the north line of said Lot 7, a distance of 2,284.48 feet to a point
on the west line of Broadmoor Park No. 1, according to the official

plat thereof recorded in volume "D" of plats, page 28,thence
N00°11'10"E, along said west line, a distance of 38.39 feet to the
south line of Lot 1, Block 5 of said plat, thence S89°48'36"E, along
said south line, a distance of 320.00 feet, thence N00'1 1'09"E,
along the east line of said plat, a distance of 483.37 feet; thence
nN89°02'38"W, a distance of 2,597.43 feet to a point on the east
right of way line of Broadmoor Boulevard; thence S00°57'22"W,
along said right of way, a distance of 526.00 feet to the Point of
Beginning.
Section 4. That the change of a zoning classification as provided in
Section 1 is contingent, and conditioned upon execution and compliance with a
Concomitant Agreement entered into between the Petitioner and the City which
will attach to and run with the real property described in Section 3 above. Said
Concomitant Agreement is attached to this Ordinance as Exhibit No. "3".
Section 5. This ordinance shall take full force and effect five (5) days
after its approval, passage and publications required by law.
PASSED by the City Council of the City of Pasco, Washington, and
approved as provided by law this 6th day of May 2002.
