AN ORDINANCE OF THE CITY OF PASCO, WASHINGTON, AMENDING SECTION 8.02.360 "PENALTY PROVISIONS" AND SECTION 11.02.010 "APPLICABILITY OF CHAPTER" PROVIDING ALTERNATIVE ADMINISTRATIVE DETERMINATION OF ANIMAL CODE VIOLATIONS BEFORE THE PASCO CODE ENFORCEMENT BOARD WHEREAS, in order to provide for an efficient means of resolving code violation infractions by means of an administrative remedy, it has been determined that many of the animal code provisions, more particularly those involving licensing, may be heard and determined by the Code Enforcement Board of the City of Pasco, Washington; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. That Section 8.02.360 entitled "Penalty Provisions" of the Pasco Municipal Code shall be and hereby is amended and shall read as follows: 8.02.360 PENALTY PROVISIONS. (1) Any person violating any provisions of this chapter, except sections 8.02.130, 8.02.170 and 8.02.320, is guilty of an infraction. Unless matters in aggravation warrant a greater civil penalty, each violation shall be subject to a minimum penalty in the amount listed plus all costs and assessments: (a) First violation within five years $30.00. (b) Second violation within five years $50.00. (c) Third violation within five years $75.00. (d) Four or more violations within five years $100.00. (2) Each person is guilty of a separate offense for each and every day during any portion of which any violation of the provisions of this chapter is committed, continued or permitted by any such person and shall be punished accordingly. Court costs of $10.00 shall be assessed in addition to any other fine, penalty, cost or statutory assessment imposed. Ordinance Amending Sections 5.02.360 and 11.02.010- 1 The City, at its election mqy divert aLiy infractions identified in subsection (1), above, to be heard before the Pasco Code Enforcement Board pursuant to Chapter 11.02 of the Pasco Municipal Code Assessments of monetary penalties for violations of this chapter shall be assessed by the Code Enforcement Board in accordance with subsection 1 a through d above. Section 2. That Section 11.02.010 .entitled "Applicability of Chapter" of the Pasco Municipal Code shall be and hereby is amended and shall read as follows: 11.02.10 APPLICABILITY OF CHAPTER. The provisions of this chapter shall apply to enforcement of Title 5 (excluding Chapters 5.12 - Pawnbrokers and Second-Hand Dealers and 5.46 - Private Detective Agencies, Private Detectives, Private Security Guards, and Private Security Companies), Title 6 - Health and Sanitation, Title 12 - Streets and Sidewalks, Title 16 - Building Code, Title 17 - Sign Code, Title 18 - Fire Prevention, Title 19 - Mobile Homes, Title 22 - Zoning, and Chapters 8.02 (excepting Sections 8.02.130, 8.02.170 and 8.02.320) - Animal Control, 9.60 - Public Nuisances, 9.61 - Noise Regulation, and 9.62 - Abandoned Vehicles and Vehicle Hulks. Section 3. This Ordinance shall take full force and effect five days after its approval, passage and publication as required by law.
