HomeMy WebLinkAbout3533 Ordinance ORDINANCE NO. 3533 AN ORDINANCE assigning zoning to certain real property within the City of Pasco. WHEREAS, on January 17, 2002, the Planning Commission of the City of Pasco conducted a public hearing to develop a recommendation for the assignment of zoning to certain properties; in the event those properties were incorporated within the City; and WHEREAS, on February 28, 2002, Ordinance No. 3532, effectively annexed certain real property to the City of Pasco, NOW, THEREFORE, THE CITY COUNCII, OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. That the following described areas, situated in Franklin County, Washington to-wit: Area 1. Beginning at a point on the north right-of-way line of Court Street, said point being the intersection of the north right-of-way line of Court Street and the east right-of-way line of Road 100; Thence southerly along the southerly projection of the east right-of-way line of Road 100 to the intersection with the south right-of-way line of Court Street; Thence westerly along the south right-of-way line of Court Street to the intersection with the northwest corner of tax parcel number 118-302-015; Thence southerly along the west line of said tax parcel number 118-302-015 to the intersection with the west line of Section 20, Township 9, North Range 29 East; Thence southerly along the west line of said Section 20 to the intersection with the low water mark of the Columbia River shoreline; Thence southeasterly along said shoreline to the southerly projection with the east line of tax parcel number 118-302-284; Thence northerly along the southerly projection of said tax parcel number and continuing northerly along the east line of said tax parcel number to the south right-of-way line of Court Street; Thence northerly along the northerly projection of the east line of tax parcel number 118-302-284 to the intersection with the north right-of-way line of Court Street; Thence westerly along the north right-of-way line of Court Street to the point of beginning; Area 2. Beginning at a point on the south right-of-way line of Sturgis Road, said point being the intersection of the south right-of-way line of Sturgis Road and the east right-of-way line of Road 96; Thence easterly along the south right-of-way line of Sturgis Road to the intersection with Road 94; Thence northerly along the east right-of-way line of Road 94 to the intersection with the south right-of- way line of Court Street; Thence northerly along the northerly projection of the east right-of-way line of Road 94 to the intersection with the north right-of-way line of Court Street; Thence easterly along the north right-of-way line of Court Street to the intersection with the east right-of-way line of Road 76; Thence southerly along the southerly projection of the east right-of-way line of Road 76 to the southeast corner of Court Street and Road 76; Thence southerly along the east right-of-way line of Road 76 and continuing southerly along the projection of the east right-of-way line of Road 76 to the intersection with the low water line of the Columbia River Shoreline; Thence northwesterly along said Columbia River shoreline to the intersection with the southerly projection of the east right-of-way line of Road 96; Thence northerly along the projection of the east line of Road 96 and continuing northerly along the east right-of-way line of Road 96 to the point of beginning. Area 3. Beginning at a point on the north right-of-way line of Court Street, said point being the intersection of the north right-of-way line of Court Street and the east right-of-way line of Road 72; Thence northerly along the east right-of-way line of Road 72 to the intersection with the south right-of-way line of Wernett Road; Thence westerly along the westerly projection of the south right-of-way line of Wernett Road to the intersection with the west right-of-way line of Road 72 and continuing westerly along the south right-of-way line of Wernett Road to the intersection with the west line of the east half of the west half of the of the southeast quarter of Section 21, Township 9 North, Range 29 East; Thence southerly along the west line of the east half of the west half of the southeast quarter of Section 21, Township 9 North, Range 29 East to the intersection with the north line of Short Plat 93-17; Thence westerly along the north line of Short Plat 93-17 to the intersection with the east right-of-way line of Road of 76; Thence southerly along the east right-of-way line of Road 76 to the intersection with the north right-of-way line of Court Street; Thence easterly along the north right-of-way line of Court Street to the point of beginning. Area 4. Beginning at the northeast corner of Lot 1 Plat of Glen Acres Subdivision; Thence westerly along the northern boundary of said plat to the northwest corner of Lot 5 thereof, Thence southerly along the west boundary line of said plat to the southwest corner of Lot 13 and continuing southerly along the southerly projection of said west boundary line to the intersection with the low water line of the Columbia River shoreline; Thence easterly along said shoreline to the intersection with the southerly projection of the west right-of-way line of Road 68; Thence northerly along the southerly projection of said west right-of- way line and continuing north along said west right-of-way to the intersection -2- with the north boundary line of the Plat of Glen Acres Subdivision the same being the point of beginning. as depicted in the map attached hereto and labeled Exhibit 1 be and the same are hereby assigned R-S-20 ( Suburban Residential) zoning. Section 2. That the following described areas, situated in Franklin County, Washington to-wit: Area S. Beginning at a point on the south right-of-way line of Sturgis Road, said point being the intersection of the south right-of-way line of Sturgis Road and the east right-of-way line of Road 96; Thence easterly along the south right-of-way line of Sturgis Road to the intersection with Road 94; Thence northerly along the east right-of-way line of Road 94 to the intersection with the south right-of- way line of Court Street; Thence northerly along the northerly projection of the east right-of-way line of Road 94 to the intersection with the north right-of-way line of Court Street; Thence westerly along the north right-of-way line of Court Street to the intersection with the northerly projection of the east line of tax parcel number 118-302-284; Thence southerly along the northerly projection of the east line of said tax parcel number and continuing southerly along the east line of said tax parcel and along the southerly projection thereof to the intersection with the low water line of the Columbia River Shoreline; Thence southeasterly along said Columbia River shoreline to the intersection with the southerly projection of the east right-of-way line of Road 96, Thence northerly along the southerly projection of the east right-of-way line of Road 96 and continuing northerly along the east right-of-way line of Road 96 to the point of beginning. Area 6. All of Back Roads Country Estates together with Lots 3 and 4 Short Plat 76-10 including the adjoining Road 80 right-of-way. Area 7. Beginning at a point on the south right-of-way line of Sylvester Street said point being the intersection of the south right-of-way line of Sylvester Street and the west right-of-way line of Road 54; Thence northerly along the northerly projection of the west right-of-way line of Road 54 to the intersection with the north right-of-way line of Sylvester Street; Thence westerly along the north right-of-way line of Sylvester Street to the intersection with the east right-of- way line of Road 60; Thence northerly along the east right-of-way line of Road 60 to the intersection with the easterly projection of the north line of Lot 8, Sunflower Estates; Thence westerly along the easterly projection of said Lot 8 -3- and continuing westerly along the north line of said Lot 8 to the northwest corner thereof; Thence southerly along the west line of said Lot 8 to the southwest corner thereof, said corner also being the northeast corner of Lot 4, Short Plat 98-20; Thence westerly along the north line of Lot 4, Short Plat 98- 20 to the intersection with the east right-of-way line of Road 64; Thence northerly along the east right-of-way line of Road 64 to the intersection with the easterly projection of the north line of Tax Parcel number 119-661-117; Thence westerly along the easterly projection of said Tax Parcel number and continuing westerly along the north line of said Tax Parcel number to the intersection with the west line thereof; Thence southerly along the west line of said Tax Parcel number to the intersection with the north boundary line of Short Plat Number 77-12; Thence westerly along the north boundary line of said Short Plat and continuing westerly along the westerly project of said north boundary line of said Short Plat on a bearing such that said projection intersects with the northeast corner of Lot 2 Vineyard Estates; Thence southerly along the east line of said Lot 2 to the south line there of; Thence westerly along the south line of Lot 2, Vineyard Estates to the intersection with the east right-of-way line of Road 68; Thence southerly along the east right-of- way line of Road 68 and continuing southerly along the southerly projection of said right-or-way line to the intersection with the low water line of the Columbia River Shoreline; Thence southeasterly along said Columbia River shoreline to the intersection with the southerly projection of the west right-of- way line of Road 54; Thence northerly along the southerly projection of the west right-of-way line of Road 54 and continuing northerly along the west right-of-way line of Road 54 to the point of beginning. as depicted in the map attached hereto and labeled Exhibit 1 be and the same are hereby assigned R-S-12 ( Suburban Residential) zoning. Section 3. That the following described area, situated in Franklin County, Washington to-wit: Area 8. Beginning at a point of the north right-of-way line of Court Street, said point being the intersection of the north right-of-way line of Court Street and the east right-of-way line of Road 76; Thence southerly along the east right-of-way line of Road 76 to the intersection with the low water line of the Columbia River shoreline; Thence southeasterly alone said Columbia River shoreline to the intersection with the southerly projection of the west line of the Plat of Glen Acres Addition; Thence northerly along the southerly projection of said Plat and continuing northerly along the west line of said plat and the northerly projection of the west line of said Plat to the intersection with the south line of Court Street; Thence westerly along the south right-of-way line of Court Street to the point of beginning. -4- as depicted in the map attached hereto and labeled Exhibit 1 be and the same is hereby assigned RS-1/PUD (Suburban Residential as a Planned Unit Development) zoning with development conditions as approved by the Board of County Commissioners dated March 13, 2002 and September 18, 2000. Section 4. That the following described area, situated in Franklin County, Washington to-wit: Area 9. Shot Plat 74-3 and adjoining streets. as depicted in the map attached hereto and labeled Exhibit 1 be and the same is hereby assigned R-2 (Medium Density Residential) zoning. Section 5. That the following described area, situated in Franklin County, Washington to-wit: Area 10. Beginning at a point on the south right-of-way line of Court Street said point being the intersection of the south right-of-way line of Court Street and the west right-of-way line of Road 64; Thence southerly along the west right-of-way line of Road 64 to the intersection with the north line of Tax Parcel number 119-661-117; Thence westerly along the north line of said Tax Parcel number to the intersection with the west line thereof, Thence southerly along the west line of said Tax Parcel number to the intersection with the north boundary line of Short Plat Number 77-12; Thence westerly along the north boundary line of said Short Plat and continuing westerly along the westerly project of said north boundary line of said Short Plat on a bearing such that said projection intersects with the northeast corner of Lot 2 Vineyard Estates; Thence southerly along the east line of said Lot 2 to the intersection with the south line thereof; Thence westerly along the south line of Lot 2, Vineyard Estates to the intersection with the east right-of-way line of Road 68; Thence southwesterly across Road 68 to the intersection with the northeast corner of lot 1 Plat of Glen Acres Subdivision; Thence westerly along the north line of the Plat of Glen Acres Subdivision to the intersection with the west line of Short Plat 93-8; Thence northerly along the west line of short Plat 93-8 to the intersection with the south line of Court Street; Thence easterly along the south line Court Street to the point of beginning. as depicted in the map attached hereto and labeled Exhibit 1 be and the same is hereby assigned C-1 ( Retail Business) zoning. Section 6. That any and all zoning maps be and the same are hereby amended to conform to the aforesaid assignment of zoning. -S- Section 7.
