ORDINANCE NO. 3501
AN ORDINANCE vacating a portion of West Court Street
WHEREAS, a qualified petition has been submitted to the City Council of
the City of Pasco requesting vacation of certain public rights-of-way within the
City of Pasco; and
WHEREAS, from time to time, in response to petitions or in cases where
it serves the general interest of the City, the City Council may vacate rights-of-
way; and
WHEREAS, all steps and procedures required by law to vacate said
right-of-way here been duly taken and performed; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES
ORDAIN AS FOLLOWS:
Section 1. That the following described West Court Street right-of-way,
as depicted in Exhibit "1" be and the same are hereby vacated subject to the
easement identified in Section 2 and the exception identified in Section 3
hereof-
That portion of the right--of-way as described in deed recorded under
Auditor's File No. 254730, records of Franklin County, Washington, lying in the
east half of the northwest quarter of the northeast quarter of Section 25,
Township 9 North, Range 29 East of the Willamette Meridian, City of Pasco,
Franklin County, Washington, being more particularly described as follows:
Beginning at the northwest corner of said subdivision, said point being
marked by a brass cap monument at the intersection of Court Street and Road
26; thence north 89°01'37" east, 443.06 feet along the north line of said
subdivision and along the centerline of Court Street to highway engineer's
station CS 37+50; thence south 0°58'23" east, 55.00 feet to the south line of
said right-of-way; thence south 87°37'35" west, 238.40 feet along said south
line to the true point of beginning;
Thence continuing south 87°37'35" west, 40.02 feet along said south
line; thence north 0°21'42" west, 21.81 feet to a point that lies 40.00 feet south
of the centerline of said Court Street; thence north 89°01'37" east, 40.00 feet
parallel with said centerline; thence south 0°21'42" east, 20.83 feet to the true
point of beginning; and,
That portion of the right-of-way as described in deed recorded under
Auditor's File No. 254730, records of Franklin County, Washington, lying in the

Township 9 North, Range 29 East of the Willamette Meridian, City of Pasco,
Franklin County, Washington, being more particularly described as follows:

point that lies 40.00 feet south of the centerline of said Court Street; thence
north 89°01'37" east, 140.40 feet parallel with said centerline; thence south
0°21'42" east, 21.81 feet to the true point of beginning, and,

Township 9 North, Range 29 East of the Willamette Meridian, City of Pasco,
Franklin County, Washington, being more particularly described as follows:
Beginning at the northwest corner of said subdivision, said point being
marked by a brass cap monument at the intersection of Court Street and Road
26; thence north 89°01'37" east, 443.06 feet along the north line of said

Thence continuing south 87°37'35" west, 125.48 feet along said south
line; thence north 0°21'42" west, 20.83 feet to a point that lies 40.00 feet south
of the centerline of said Court Street; thence north 89°01'37" east, 125.40 feet
parallel with said centerline; thence south 0°23'33" east, 17.76 feet to the true
point of beginning.
Section 2. That the City shall retain an easement and the right to
exercise or grant easements with respect to north 15 feet of the vacated south
right-of-way of West Court Street for the construction, repair and maintenance
of public utilities and services.
Section 3. That the City shall retain as a right-of-way a 25 foot radius
at the southeast intersection of 26"' Avenue and Court Street all within the
right-of-way described in Section 1.
Section 4. That a certified copy of this ordinance be recorded by the
City Clerk of the City of Pasco in and with the office of the Auditor of Franklin
County, Washington.
Section 5. This ordinance shall be in full force and effect five days after
passage and publication or summary publication as required by law.

SUMMARY OF ORDINANCE NO. 3501
ORDINANCE NO. 3501 is an ordinance vacating a portion of West Court
Street.
Section 1. Describes the portion of the south side of West Court Street
between 24th Ave. and 26th Ave that was vacated.
Section 2. Retains a 15-foot utility easement on a portion of the vacated
right-of-way.
Section 3. Retains a 25-foot radius at the intersection of Court and 26th.
Section 4. States that a copy of the ordinance is to be recorded with the
County Auditor.
Section 5. Requires the ordinance or this summary herein to be published
before the ordinance is in effect.
