ORDINANCE NO. 3480
AN ORDINANCE of the City of Pasco, Washington, Amending
Section LA of Ordinance 3423 Imposing a Moratorium on Special Use
Permits Applications, Building Permit Applications, or Business
License Applications Within the Pasco Downtown Development
Association Boundaries.
WHEREAS, the City Council established a moratorium on Community
Service Facilities in the general downtown area in July 2000, pending completion
of the study of appropriate zoning regulations for the downtown area; and
WHEREAS, the public hearing conducted by the City Council on July 2,
2001 revealed a predominant concern by citizens that churches are unnecessarily
included in the moratorium; and
WHEREAS, the City Council finds the continued inclusion of churches
within the scope of said moratorium to be unnecessary;
WHEREAS, RCW 36.70A.035(2)(b)(v) authorizes amendments to a
moratorium imposed pursuant to RCW 36.70A.390 without additional public
review and comment; NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That Section 1 entitled "Definitions" of Ordinance No. 3423,
Passed by the Council of the City of Pasco on the 22" day of May, 2000; supported
by Findings of Fact adopted in Ordinance 3428, Passed by the Council of the City
of Pasco on the 17' day of July, 2000; and extended for a period of six months by
Ordinance 3477, Passed by the Council of the City of Pasco on the 2' day of July,
2001; shall be and hereby is amended and shall read as follows:
Section 1. Definitions. For the purpose of this ordinance, the following
definitions shall apply:
A. "Community Service Facilities" includes, but is not limited to,
daycare centers, nursery schools, hospitals, sanitariums, ehur-ehes; drug
abuse and alcoholic treatment centers, halfway houses, charitable
organizations, nonprofit service groups,juvenile care and treatment centers,
governmental and quasi-governmental activities, and other similar uses
which provide social, health, and welfare services for citizens; except any
such use which limits the activity solely to organizational or administrative
office functions, whereby the actual community service is provided
elsewhere, shall be excluded from this definition.
Section 2. This Ordinance shall take full force and effect five (5) days after
its approval, passage and publications required by law.
PASSED by the City Council of the City of Pasco, Washington and approved
as provided by law this 6" day of August, 2001.
