AN ORDINANCE of the City of Pasco, Washington, providing
for the re-enactment of Ordinance No. 3379, entitled "An Ordinance
Providing for an Increase in Sewer Rates and Charges; and Amending
Pasco Municipal Code Sections 13.40.030 and 13.40.040."
WHEREAS, the 1999 Sewer Classification Study by Economic and
Engineering Services, Inc. determined that it was appropriate and necessary to
raise commercial rates and charges and lower hotel and motel rates for the City
sewer services, which resulted in the enactment of Ordinance No. 3379, entitled "An
Ordinance Providing for an Increase in Sewer Rates and Charges; and Amending
Pasco Municipal Code Sections 13.40.030 and 13.40.040" on the 7t` day of
September, 1999, and
WHEREAS, on November 7, 2000, Initiative Measure 722 was approved by
the voters of the State of Washington, purporting to declare any tax increase,
including water, sewer and other utility charges, adopted after July 2, 1999 through
December 31, 1999, as null and void and of no effect therefore, putting in question
the continued enforceability of Ordinance No. 3379, and
WHEREAS, Ordinance No. 3379 was adopted to promote the public health,
safety and welfare to equitably apply sewer rates and charges, and its continued
application is necessary for the well being of the citizens of the City of Pasco, and
WHEREAS, the constitutionality of Initiative Measure 722 is presently in
the process of judicial review thereby calling into question the effect of this
initiative, and therefore, to affect the continued enforceability of this ordinance,
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO
ORDAIN AS FOLLOWS:
Section 1. That Ordinance No. 3379 entitled "An Ordinance Providing for
an Increase in Sewer Rates and Charges; and Amending Pasco Municipal Code
Sections 13.40.030 and 13.40.040," and codified as Sections 13.40.030 and 13.40.040
of the Pasco Municipal Code, entitled "Hotel and Motel Monthly Rate and
Commercial Monthly Rate," a true and accurate copy of which is attached hereto as
Exhibit No. 1 and incorporated by this reference as if set out in full, is hereby re-
enacted, ratified and confirmed in all respects.
Section 2. This ordinance shall take full force and effect five days after its
approval, passage and publication as required by law.

ORDINANCE NO. 3379
AN ORDINANCE providing for an increase in sewer rates and
charges over a two year period and amending Pasco Municipal
Code Section 13.40.030 "Hotel and Motel Monthly Rate" and
13.40.040 "Commercial Monthly Rate."
WHEREAS, the 1999 Sewer Classification Study by Economic and
Engineering Services, Inc., has determined it is appropriate and necessary to
raise commercial rates and charges and lower hotel and motel rates for City
sewer services, and
WHEREAS, it is deemed in the best interest of the citizens of the City of
Pasco to stage such increase over a period of time to minimize its impact, NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO
ORDAIN AS FOLLOWS:
§1. Section 13.40.030 of the Pasco Municipal Code is hereby amended
to read as follows (new language shown by underlining and deletions shown by
's tr-ikethru):
13.40.030 HOTEL AND MOTEL MONTHLY RATE. The monthly rate for
hotels and motels within the corporate limits of the City of Pasco shall be
delve six dollars ($12.00) (6.00) per unit per month, plus $1.23 per one
hundred cubic feet for all water used over one thousand cubic feet per
month; provided, that from and after November 1, 2000, such rate shall
be six dollars ($6.00) per unit per month, plus $1.29 per one hundred
cubic feet of all water used over one thousand cubic feet per month.
§2. Section 13.40.040 of the Pasco Municipal Code is hereby amended
to read as follows:
13.40.040 COMMERCIAL MONTHLY RATE. The monthly sewer
amounts charged to commercial accounts inside the corporate limits of
the City of Pasco shall be thirty fOUF deflars fifty cents ($34.50) thirty-six
dollars five cents ($36.05) minimum plus $1.18 1.23 per one hundred
cubic feet for all water used over one thousand cubic feet per month;
provided, that from and after November 1, 2000, such charge shall be
$37.67 minimum plus $1.29 per one hundred cubic feet of all water,used
over one thousand cubic feet per month.
P. This ordinance shall take full force and effect on November 1, 1999.
Passed by the City Council of the City of Pasco, at a regular meeting this
20th day of September, 1999.
