AN ORDINANCE CREATING CHAPTER 2.23 LAW
ENFORCEMENT AND FIRE FIGHTER DISABILITY BOARD IN THE
PASCO MUNICIPAL CODE AND CODIFYING ORDINANCE NO.
2811.
WHEREAS, the City Council adopted Ordinance No. 2811 establishing a
Law Enforcement Officers and Firefighters Disability Board pursuant to RCW
41.26.110; and,
WHEREAS, said Ordinance did not create or codify a chapter in the
Pasco Municipal Code; and,
WHEREAS, the City Council desires to include provisions pertaining to
the Law Enforcement Officers and Firefighters Disability Board in the Pasco
Municipal Code; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That Title 2 of the Pasco Municipal Code be, and the same is
hereby amended, to include a new Chapter 2.23 to read as follows:
CHAPTER 2.23
LAW ENFORCEMENT OFFICERS AND FIREFIGHTERS DISABILITY BOARD
Sections:
2.23.010 Created - purpose.
2.23.020 Membership.
2.23.030 Terms of office.
2.23.040 Powers and duties of board.
2.23.010 CREATED - PURPOSE. Effective April 15, 1991, there is
hereby created a Law Enforcement Officers and Firefighters Disability Board
under authority of RCW 41.26.110, to herein decide claims for disability and
medical services.
2.23.020 MEMBERSHIP. The board membership shall consist of the
following five members: two members of the City Council to be appointed by the
mayor; one active or retired firefighter to be elected by the firefighters employed
by or retired from the City; one active or retired law enforcement officer to be
elected by the law enforcement officers employed by or retired from the City;
and one member from the public at-large who resides within the City to be
appointed by the other four members heretofore designated in this section.
Retired members who are subject to the jurisdiction of the board have
the right to elect and the right to be elected under this section.
2.23.030 TERMS OF OFFICE. The terms of the members shall be as set
forth in RCW 41.26.110, as it may be amended from time-to-time. Currently,
the terms of both elected and appointed members are for two-years.
2.23.040 POWERS AND DUTIES OF BOARD. The board shall adopt
rules and regulations, which shall enable it to fairly and efficiently carry out its
responsibilities as set forth in the statutes and applicable administrative
regulations.
Section 2. This ordinance shall be in full force and effect five days after
passage and publication as required by law.
PASSED by the City Council of the City of Pasco, at its regular meeting
this 2nd day of October 2000.
