AN ORDINANCE OF THE CITY OF PASCO,
WASHINGTON, RELATING TO LAND USE AND
DECLARING A GENERAL WELFARE EMERGENCY
NECESSITATING AN IMMEDIATE MORATORIUM ON
THE ACCEPTANCE OF APPLICATIONS FOR SPECIAL
USE PERMITS, BUILDING PERMITS, LOCATION
CHANGES AND LICENSES FOR COMMUNITY
SERVICE FACILITIES TO BE EFFECTIVE FOR A
PERIOD OF UP TO SIX MONTHS, AND SETTING A
DATE FOR A PUBLIC HEARING ON THE
MORATORIUM.
WHEREAS, the City of Pasco is responsible for guiding
development within the corporate limits of the City, and;
WHEREAS, from time to time the City Council relies on the
recommendations of citizen groups, appointed committee's and
recognized organizations and associations for the development of
policies and regulations affecting the location of land uses within the
City, and;
WHEREAS, the City of Pasco has expended considerable
resources to maintain and enhance the central business district and
surrounding commercial areas, and;
WHEREAS, the City has supported and worked closely with the
Pasco Downtown Development Association for the betterment of the
downtown area, and;
WHEREAS, the concentration of certain land uses can contribute
to business loss and the decline of property values as well as creating
a public image that is undesirable and detrimental to public and
private investment within the downtown area,
WHEREAS, there are no current pending applications for
Community Service Facilities uses within the Pasco Downtown
Development Association boundaries; and
WHEREAS, there is an urgent need, pending the development of
a long-range plan for the Pasco Downtown Development Association
boundaries to preserve the status quo; NOW THEREFORE,
BE IT ORDAINED by the City Council of the City of Pasco,
Washington as follows:
Section 1. Definitions. For the purpose of this ordinance, the
following definitions shall apply:
A. "Community Service Facilities" includes, but not limited to,
daycare centers, nursery schools, hospitals, sanitariums,
churches, drug abuse and alcoholic treatment centers,
halfway houses, charitable organizations, nonprofit service
groups, juvenile care and treatment centers, governmental
and quasi-governmental activities, and other similar uses
which provide social, health, and welfare services for citizens;
except any such use which limits the activity solely to
organizational or administrative office functions, whereby the
actual community service is provided elsewhere, shall be
excluded from this definition.
Section 2. Purpose. The purpose of this ordinance is to permit
the Pasco Downtown Development Association to complete a long-
range plan for the development, redevelopment and use of lands with
in the Association boundary, as depicted in Exhibit I attached hereto,
without concern about certain uses locating within said boundaries
and affecting the plan during the course of its development.
Section 3. Moratorium Imposed. The City Council hereby
imposes a moratorium on the acceptance of special use permit
applications, building permit applications, or business license
applications for Community Services Facilities as defined herein
within a geographic area comprising the Pasco Downtown
Development Association boundaries as identified and depicted in
Exhibit I attached hereto. The Pasco Downtown Development
Association will complete a long-range plan for the lands within the
Association boundaries during the period of the moratorium.
Following the completion of the plan the City of Pasco may or may not
develop regulations to assist with implementation of said long-range
plan.
Section 4. Effective Period. For a period of at least six months
from the effective date of this ordinance, or until the Pasco Downtown
Development Association completes it's long-range plan for lands
within the Pasco Downtown Developments Association boundaries as
depicted in Exhibit I attached hereto and the City Council officially
accepts the plan and adopts the necessary municipal code

amendments to implement said plan, no special use permit
application, building permit application, or business license
application which is applied for after the effective date of this
ordinance, shall be accepted or issued for any Community Service
Facility use as defined herein during the effective period of this
moratorium.
Section 5. Public Hearina on Moratorium. Pursuant to RCW
35A.63.220, the City Council shall hold a public hearing on this
moratorium within sixty {60} days of its adoption, or on July 17,
2000. Immediately after the public hearing, the City Council shall
adopt findings of fact on the subject of this moratorium, and either
justify its continued imposition or cancel the moratorium.
Section 6. Severability. If any section, subsection, paragraph,
sentence, clause or phase of this ordinance is declared
unconstitutional or invalid for any reason, such invalidity shall not
effect the validity or effectiveness of the remaining portions of this
ordinance.
Section 7. Declaration of Emer enc . The City Council hereby
declares that an emergency exists necessitating that this ordinance
take effect immediately upon passage by a majority plus one of the
whole membership of the Council to protect the general welfare of the
community.
Section 8. Effective Date. This ordinance shall take effect and
be in full force and effect immediately.
