AN ORDINANCE permitting the dispensing and consumption of beer/wine and spirituous liquor in the Farmers Market area located at 4th Avenue and Columbia Street at the Cinco de Mayo Celebration on May 1, 1999. THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS. Section 1. On the conditions hereafter specified , it is lawful for the Pasco Downtown Development Association , a non-profit organization, to dispense beer/wine at a designated location within the boundfaries of the Pasco Farmers Market located at 4th Avenue and Columbia Street on May 1, 1999, and for persons of legal age to possess , display or consume such beer/wine and spirituous liquor at such designated location during the celebration. Provided, however, before dispensing beer/wine and spirituous liquor at the celebration, the Association must first obtain a permit to do so from the Administrative and Community Services Director. Such permit shall be issued only upon the following conditions : (a) The applicant must produce evidence of possession of permit from the Washington State Liquor Control Board; and (b) The applicant must deposit a sum of Two Hundred and Fifty Dollars ($250) to insure proper performance of cleanup by the applicant subsequent to the event for which the permit is issued and for payment of damages ; and (c) The payment of a fee in the amount of One Hundred and Fifty Dollars ($150). The fee may be waived if the City Council finds that there is no private profit to be derived from the dispension of the beer/wine and spirituous liquor by the applicant organization , or any other members or representatives thereof; and (d) The applicant agrees that he or she will save the City of Pasco harmless from all losses or damages occasioned to the applicant or to any third person or party by reason of any act or omissions of the applicant or anyone dispensing, consuming or possessing beer/wine pursuant to the permit. Applicant shall , after reasonable notice thereof, pay the expense of any suit which may be commenced against the City of Pasco by any third person alleging injury or loss by reason of such acts ; and (e) Agreement by the applicant to comply with all reasonable requests by the Administrative and Community Services Director for security, traffiic control , dispensing beer/wine and spirituous liquor and cleanup ; and (f) The applicant shall comply with all other applicable city codes and regulations . Section 2. This ordinance shall take effect five (5) days after passage and publication according to law .
