ACTION REQUESTED OF COUNCIL / STAFF RECOMMENDATIONS: 2/25: Discussion III. FISCAL IMPACT: Unknown IV. HISTORY AND FACTS BRIEF: A) The Wagenaar Army Reserve Center located adjacent the Port of Pasco (at the intersection of Oregon and Ainsworth) has been declared surplus by the Department of Defense. The Department's Office of Economic Adjustment (OEA) is responsible to coordinate with local entities to determine the most appropriate party for transfer of the property. That process requires a "Local Redevelopment Authority" (LRA) to conduct a planning process and make a formal recommendation to the OEA as to appropriate disposal of the property. B) The city, in early 2006, recommended the Port of Pasco be designated as the LRA, as the Port owns property nearby the Reserve Center and .is an established local public entity that could carry out the planning process. Unfortunately, the Port has recently withdrawn from the process due to the perception on the part of some that the Port has a conflict of interest if the Port both conducts the planning process and makes a proposal for acquisition of the property. Consequently, the OEA has requested the city to assume the LRA responsibility or identify another local entity to do so. By letter from the Mayor, the city requested additional time to collect more information about the obligations associated with carrying out the process; apparently, the OEA has declined to grant additional time for the city to consider the request. V. DISCUSSION: A) Staff requested that representatives of OEA attend the February 25 workshop meeting to provide both an overview of the process and answer questions Council may have about the obligations associated with the request. TECHNOLOGY JAN 31 2008 ANO LOGISTICS Honorable Joyce Olson Mayor of City of Pasco Pasco, WA 99301 Dear Mayor Olson: Pursuant to the 2005 Defense Base Closure and Realignment process,property at PFC Daniel L. Wagenaar U.S. Army Reserve Center was determined to be surplus to the needs of the Federal Government and available for civilian reuse. The Base Closure Community Redevelopment and Homeless Assistance Act of 1994 establishes a transition process for surplus real property that is available for reuse. The process begins with the Department's recognition of a Local Redevelopment Authority (LRA) and ends with the Military Department transferring the property to other governmental entities or to private ownership. In the case of this specific installation, the Office of Economic Adjustment (OEA) previously contacted the City of Pasco and provided information regarding the redevelopment planning process. At the request of the City of Pasco, OEA recognized the Port of Pasco as the LRA on May 17, 2006. However, on January 15, 2008, the Port of Pasco withdrew as the LRA. An LRA is important to obtaining civilian reuse of this installation. Please indicate by return correspondence whether a local entity, with appropriate jurisdiction over this property, requests recognition as the LRA for this installation. Negative replies are also requested. In the event that this office is not in receipt of a response within 30 days from the date of this letter, the Department will assume a negative response. In the absence of an LRA at the local level,the Department will write to Governor Gregoire to seek State interest to either serve as the LRA or to identify an appropriate entity for recognition. O'Brien,Director Office of Economic Adjustment 3000 Defense Pentagon Washington,D.C. 20301-3000 RE: Wagenaar Reserve Center, Pasco Dear Mr. O'Brien: The City of Pasco is in receipt of your January 31 letter inquiring of the city's interest to serve as the Local Redevelopment Authority (LRA) regarding the Army Reserve Center in Pasco determined previously by the Army to be surplus to the needs of the Federal Government. While we have some knowledge of the Port of Pasco's LRA effort over the past 18 months regarding the Pasco facility, we are not fully familiar with the obligations associated with accepting LRA status. We will need some additional time to attain a satisfactory level of knowledge about the subject and associated processes hefore making a determination about LRA designation. To that end, please regard this letter as a request to provide an additional 45 days (through April 15) for the city to advise you in writing as to its preference. Please feel free to contact Pasco City Manager, Gary Crutchfield (5019-545-3404) regarding this matter prior to Council determination about LRA status, as he has been in contact with Mr. Tony Gallegos and Ms. Amanda Fagan of your organization. MOTION: I move to approve Resolution No, authorizing the sale of a seized/forfeiture vehicle considered surplus to City needs. III. FISCAL IMPACT: IV. HISTORY AND FACTS BRIEF: A) Weapons 1. The Police Department has acquired 12 weapons through forfeiture and 1 unclaimed action. The weapons have been processed through the Police Department and are now available for disposal through a Licensed Federal Firearms Dealer. The weapons are considered surplus to City needs. 2. No minimum price is suggested for each weapon. Staff requests Council to declare the weapons surplus to City needs and authorize staff to sell at auction through a Licensed Federal Firearms Dealer for a price that is in the best interest of the City. 3, Staff proposes to have the auction consigned to H.A. Rowell Auctioneers, a Licensed Firearms Dealer for a 25% commission on the gross proceeds from the sale with no charge for transporting the items to auction or advertisement thereof. B) Vehicle 1. The Police Department acquired one seized forfeiture vehicle through an Affidavit in Support of Default Judgment and Order of Forfeiture and has determined the vehicle surplus to City needs. 2. Due to its uncertain condition, no minimum price is suggested for this vehicle. Staff requests Council to declare the vehicle surplus to City needs and to authorize staff to sell at auction under terms and for a price that is in the best interest of the City. 3(d) ORIGIPasco Police Task NAL Forfeitured and Unclaimed Assets Evidence Inventory Disposition Request 14 February 2008 Below is a list representing weapons that have been approved by the Chief of Police for disposal as excess property. The individual value of each of the weapons described is less than $2,000 each. I request that each of these weapons be classed as surplus equipment and disposed of through and to only Licensed Federal Firearms Dealers.
