Mr. Watkins and Ms. Crawford requested council review the use of container storage units at a future workshop meeting. MISCELLANEOUS DISCUSSION: Mr. Crutchfield noted Franklin County Commissioners verbally agreed with the City' s suggestion to ask voters for .2% sales tax increase (instead of 3%) conditioned on the City taking full responsibility of Chiawana Park in 2006 if the tax increase is approved. Council and Staff discussed the options 1'or keeping Chiawana Park open. FXECUTZVE SESSION: Council adjourned to Executive Session at 7: 50 p.m. to discuss en forcemem action and potential hngation with legal counsel. "These responses assisted in the identification of needs and in the prioritization of improvements. ANALYSIS The applicant has applied for a Planned Unit Development (PUD) designation on 13 .45 acre ulti-family parcel in the 5900 to 6400 block of Cl-�apel Hill Boulevard. PUDS permit Rexi bili ty Cl lot sizes and lot layout that cannot be achieved through the standard development process. Planned Unit Developments may be approved for any use or combination of uses permitted in the zoning regulations except combinations o£ sidential and industrial u The minimum site area for a PUD is ten acres. The proposed site contains over thirteen acres. On of the uniqu Features of a PUD davelopm nt is the fact that it is exempt from minimum lot size and setback standards prescribed by the zoning regulations. This creates flexibility for development options. The applicant proposed to develop the PUD with multi-{amily buildings containing 4 to 5 units per building. From the public perspective the development will appear as a standard multi-family development with the exception that each building will be located on its own fee simple lot The parking, interior ss, recreation areas, courtyard and landscaped features will be held in common by the fee simple lot owners. To draw a mparison with Sun Willows, all lots within Sun Willows are fee simple lots and all roadways (access) , RV storage, pathways - and recreation areas are held in common by the lot owners. HISTORY: Wireless communication Towers are permitted uses in all ndustriai or C-3 zoning districts provide the location to such districts is not closer than SOO Feet to a residential district. In such cases the tower would require special permit approval. In addition wireless ommunication towers are permitted by special permit in all zoning districts provided the tower is attached to or located on a building that is 35 Feet high or higher and / or is to be located on a publicly owned Facility (City, Port, County, school district) such as a school site . All building permit applications For wireless communication equipment ust be accompanied by stamped engineered drawings and appropriate documentation from the FCC and FAA. ANALYSIS 'fhe proposed location of the wireless communication tower and equipment Falls under the provisions of PMC 25 . '70 . 090, which requires view and approval by special permit prior to the issuance of a building permitre The proposed tower is to be located on the western edge of the Saint Patrick's property about 475 feet directly west of the school building. The proposal calls £or the construction of a 90 Foot cellular tower. A small (26' by 12 ') equipment building will be located at the base of the pole. The equipment building and pole will be enclosed with a chain link Fence making a compound area of 2 ,500 square feet. The proposed compound area will be located in on the western edge of the school site far removed from any dwellings or other buildings. The zoning regulations were speciflcally developed to permit (through special permit r view) cellular tower/ antenna equipment on school properties . There will be no large antenna platform fixed to the top of tree pole. A portion of the height of the pole will be mitigated due to the distance the pole will be set back From neighboring streets. The proposed pole will be more than 500 feet west of 14�° Ave and more than SOO Feet north of Sylvester Street. The high school stadium is located directly to the west, vacant land is located to the south and ctaool play facilities and open space are located to the east and north . The height of the existing stadium light towers, nearby trees, the steeple of the Saint Patrick's Church and the weight of Saint Patrick's church will tend to moderate theheight o£ the pole . 2 The proposal will occupy such a nor portion of the Saint Patrick's site that it will not change the primary use of the property nor does it affect future uses in Lhe area. They are also permitted in nay other zoning district if the property is owned or controlled by a public entity such as TRAC, city , county properties or school properties_ This site is zoned residential; but it is a school property, therefore, it qualities for a special permit review.
