HomeMy WebLinkAboutHarkins Indigent Defense Addendum 1 to PSA ADDENDUM NO. 1 TO PROFESSIONAL SERVICE AGREEMENT For Legal R¢pr¢s¢ntation o£ Indigent Defendants Be£or¢ the Pasco Municipal CouR THIS ADDENDUM is entered into, effective November 17, 2010, by and between the City o{ Pasco, a Municipal Corporation, hereiaa er re{erred to as "City"% and Catherine Harkins, attorney authorized to practice law m the State of Washington, heremaft r re{erred to as °Attorney". WHEREAS, the parties to this Addendum have prcviously entered into an agreement for certain Pro{ssional Service Agreerttent for the rendering eF legal representation of indigent persons charged with misdemeanors or gross misdemeanors in the Pasco Municipal Court; and WHEREAS, the parties recognize the importance o{ responsible use and custody or video and audio recorded evidence relevant to cnmanal proceedings in the City of Pasco; and WHEREAS, the parties desire to amend that certain Professional Services Agreement by adding the additional responsibilities, rights, and duties contained herein. NOW, THEREFORE, the parties do agree as follows: 1 . 'The City may from time to time be in possession of video ey audio recorded evidence relevant to a criminal pro eeding ia which Attorney represents the criminal de{ndant. The City may 8 time to time provide such relevant video or audio evidence upon request of Attorney, or as otherwise required by law. 2. The Attorney is taking possession o{ any such evidence recognizes and agrees to the Following terms and conditions: A. The video/audio evidence is protected by Federal copyright law. B. The video/audio evidence remains the property of the City e, P see. C. The video/audio evidence shall not be used in connection with any endeavor action other tht use as mvestigative material and evidence m relevant ertmmal proceedings. D. To make no additional copies of the eviaet ee provided by the City pursuant to this Agreement, including copying o£ the evidence to a mputet, computer hard drive, or any ether type er storage device o meiu including, but not liunited to flash media, videos/audio tape, DVD ROM, er CD ROM- d m E. To not publicly disseminate the inform anon provided, including public displays o£ tbe provided audio/video evidence_ F. To return tlac video/audio evidence to the City wiUain thirty (30) days from final disposition o£ the matter. Where a guilty plea is entered, the plea date shall be the date o£ Snal disposition. Where an appeal is £llad, the evidence will be returned within thirty <30) days o£tbe appeal becoming final. G. The duplicate copy will be delivered to the Attorney in person or by legal messenger, and can then be returned to the City in the same matter. 3. This addendum shall be incorporated into the original Agreement and read with it as to c eate erte Agreement By entering into this Agreement, the parties do not intend to amend or alter any provisions o£ the original Agreement, but day hereby, add these additiortal rights and responsibilities. 4.
