Description: Sign located on NW lot Road 68 and Sandifur Pkwy PMC 17.13.010
(1) Violation:
Erecting, maintaining, locating or relocating any unpermitted off - premise sign of any kind within the City of Pasco.
(2) Corrective Action:
Remove all unpermitted off - premise signs.
Description: No City of Pasco business license for retail sales PMC 5.04.020
(1) Violation:
Engaging in business within the City of Pasco without a required City of Pasco business license.
(2) Corrective Action:
Apply for a City of Pasco business license. Discontinue ALL business activities until such time as a business license
can be obtained. Please call the City Clerk's office at (509) 545 -3402 for information on licensing requirements or view
requirements online at http:// www .pasco- wa.gov/LicensePermits.
Description: City of Pasco business license 98805 is expired PMC 5.04.020 (Renewal)
(1) Violation:
Failing to renew your City of Pasco business license and engaging in business within the City of Pasco without a
required City of Pasco business license.
(2) Corrective Action:
Renew your City of Pasco business license and pay all outstanding fees and late fees. Discontinue ALL business
activities until such time as your license has been renewed. Licenses are to be renewed annually on the first regular
business day of January, but in no case later than the last regular working day of February each year. Please call the
City Clerk's office at (509) 545 -3402 for fee information. IF YOU ARE OUT OF BUSINESS, YOU MUST CALL
THE CITY CLERK'S OFFICE AT THE NUMBER LISTED ABOVE.
Description: No dust control for driveway and parking area PMC 9.56.030, 9.56.040
(1) Violation:
Allowing blowing (fugitive) dust to leave the property.

Treat all exposed and/or disturbed soils with an approved dust control treatment (i.e. hydro seed, mulch, landscaping,
sprinkler, etc.) to prevent blowing dust from leaving the property. Driveway and parking area should be graveled.

(1) Violation:

(2) Corrective Action:

(1) Violation:
Erecting, maintaining, locating or relocating any unpermitted off - premise sign of any kind within the City of Pasco.
(2) Corrective Action:
Remove all unpermitted off - premise signs.

(1) Violation:
Plumbing fixtures (i.e. sink, toilet, shower, etc.) are not connected to an approved water system and /or are not supplied
with hot and cold running water.
(2) Corrective Action:
Reconnect residence to an approved water system and/or ensure that all required fixtures are supplied with hot and cold
water.
Description: vehicle parked on unapproved surface PMC 25.78.030 (4)
(1) Violation:
Vehicles are being parked on an unapproved surface (such as dirt or grass) and/or more than four (4) vehicles at a time
are being parked in the front driveway.
(2) Corrective Action:
Park ALL vehicles on an approved surface such as asphalt, gravel or concrete and/or discontinue parking more than 4
vehicles at a time in the front driveway.
Description: (REPEAT) MISCELLANEOUS DEBRIS FRONT AND REAR YARD. PMC 9.60.030 (6)
(1) Violation:
Any parcel within the City which is filthy, littered or trash - covered due to placing, dropping, disposing, throwing away,
or otherwise discarding litter, garbage, refuse, cans, bottles, paper or paper material, metal, organic or inorganic
material on areas of the property other than approved garbage containers.
(2) Corrective Action:
Remove and lawfully dispose of all litter, garbage, junk or vegetative waste on the property.
Description.- TIRES 17V THE REAR YARD. PMC 9.60.030 (9)
(1) Violation:
Scrap metal, ashes, bric -a -brac, broken stone or cement, broken crockery, broken glass, broken plaster, automobile
bodies and /or parts, and all such trash or abandoned material that are not kept in approved containers.

(2) Corrective Action:
Remove all vehicle parts, scrap metal, machinery, disassembled vehicles, etc. from the property or store these items in
an enclosed container or building. Remove and lawfully dispose of all junk items (e.g. any items or which have served
their intended original purpose) and unusable vehicle parts.

(1) Violation:
Unlawfully interfering with, obstructing or tending to obstruct or render dangerous for passage any public right -of -way

(2) Corrective Action:
Remove all items /objects/vehicles/etc. which may be obstructing any public right -of -way.

MEETING OF FEBRUARY 2, 2012
A. CALL TO ORDER
Chairperson Gottschalk called the regular meeting of the Code Enforcement Board to order at 7:00
p.m.
B. ROLL CALL

C. ADOPTION OF MINUTES:
Chairperson Duncan moved, seconded by Board Member Duncan, that the minutes of the January 5,
2012 meeting be approved as mailed. The motion carried unanimously.
D. DETERMINATION HEARINGS:
Chairperson Gottschalk explained the procedure and purpose for the meeting, noting that the City of
Pasco was the Petitioner and property owners and their authorized representatives who had appeared
to discuss the alleged violations of the Pasco Municipal Code were the Respondents.
a. Administration of Oaths
Mitch Nickolds, Inspection Services Manager, asked that all City staff, respondents and
any witnesses who had appeared to offer testimony before the Board be sworn to
truthfulness. Chairperson Gottschalk asked the audience if there were any objections to
any Board Member hearing any matter. There were no objections.
All City staff, respondents and witnesses who wished to provide testimony before the
Board were sworn to truthfulness.
b. Hearings Scheduled
Chairperson Gottschalk advised that the Board was now ready to proceed with the
hearings and asked the City to begin presentation of the cases to be heard.
i. City of Pasco vs. McCledon, Thomas Ryker case number CEB2011 -3374 for the
property at 3702 Stearman Ave
Mr. Nickolds called Debbie Scott, Code Enforcement Officer, to read the case facts into the
record.
Ms. Scott indicated that the cited violation on this property was Pasco Municipal Code
(PMC) 16.04.010 The complete interior demo, reconstruction of walls, mechanical,

plumbing, electrical, and ceilings. Failure to secure a City of Pasco building permit. Ms.
Scott advised the Board that the violation has not been corrected.
The City recommended that the property owners be given 10 days to correct the violation
or pay a penalty of $100 per day for 10 days.
CODE BOARD DECISION: Board Member Duncan moved, seconded by Board Member
Gutierrez, that violation of the PMC had occurred and were shown by a preponderance of
the evidence. The motion carried unanimously.
Board Member Duncan further moved, seconded by Board Member Gutierrez, be given 10
days to correct the violation or pay a penalty of $100 per day for 10 days.
Mr. Nickolds called Erin Roginski, Code Enforcement Officer, to read the case facts into
the record.
Ms. Roginski indicated that the cited violations on this property were International Property
Maintenance Code (IPMC) 504.1 Plumbing fixtures are not kept in working order or are
not free of obstructions, leaks, or defect, IPMC 602.3 Allowing occupancy of a dwelling or
sleeping unit without adequate heat in all habitable rooms, IPMC 704.2 Failure to provide
smoke detector in all required habitable areas, IPMC 304.13.1 Windows have cracks, holes
or are completely broken out, IPMC 304.13.2 Window(s) is /are not easily openable or
capable of being held in position by the window hardware, IPMC 604.3 Defects to the
electrical system in the structure constitute a hazard to the occupants (i.e. inadequate
service, improper fusing, insufficient receptacle and lighting outlets, improper wiring or
installation, deterioration or damage), IPMC 108.1.3 Allowing a structure that is in
disrepair, lacks maintenance, is insanitary, vermin or rat infested, lacks ventilation or heat,
or other essential equipment or is determined to be a hazard for any other reason by the
code official to be occupied, International Mechanical Code (IMC) 309 Failing to provide
interior space(s) intended for human occupancy with an active or passive space- heating
system capable of maintaining a minimum indoor temperature of 68 degrees Fahrenheit at a
point 3 feet above the floor. The installation of portable space heaters shall NOT be used to
achieve compliance with this section, IPMC 3 04. 10 Stairway, deck, porch, and/or balcony
is not in structurally sound condition or is in bad repair and /or not capable of supporting the
imposed loads, IPMC 304.14 Required bug screen is missing on window or door of a
habitable room, food preparation area, or food service area, IPMC 305.1 The interior
structure or equipment therein in not in good repair, is structurally unsound, or is in an
unsanitary condition, IPMC 305.3 Interior surfaces (i.e. windows, doors, floors, ceilings,
etc.) are unsanitary or damaged, IPMC 403.1 No openable window in an area used as
habitable space, IPMC 702.3 Egress door(s) are not readily openable from the side from
which egress is to be made without the need for keys, special knowledge or effort, PMC
16.04.010 Failure to secure a City of Pasco building permit and IPMC 702.1 The
continuous path of travel to the public way is obstructed and is creating an unsafe means of
egress. Ms. Roginski advised the Board that the violations have not been corrected.

The City recommended that the property owners be assessed $200 for repeat violation and
be given 10 days to correct the violations or pay a penalty of $100 per day for 10 days.
CODE BOARD DECISION: Board Member Duncan moved, seconded by Board Member
Gutierrez, that violation of the PMC had occurred and were shown by a preponderance of
the evidence. The motion carried unanimously.
Board Member Duncan further moved, seconded by Board Member Gutierrez, be assessed
$400 for repeat violation and be given 10 days to correct any life safety violations or pay a
penalty of $100 per day for 10 days and be given 90 days to complete the remaining
violations or pay a penalty of $100 per day for 10 days.
c. Amendments
Resolution 2012 -02 was amended to reflect that case CEB2011 -3464 will be dismissed
without penalty.
d. Dismissals
None
e. Motion
Board Member Duncan made a motion to accept Resolution No. 2012 -02 as amended,
Board Member Gutierrez seconded. The motion carried unanimously.
E. STAFF REPORT AND OTHER BUSINESS:

F. ADJOURNMENT
There being no further business before the Pasco Code Enforcement Board, the meeting was
adjourned by Chairperson Gottschalk at 8:12 p.m.

SUBJECT: Code Enforcement Activity Reports
Reports for the Month of January2012
Please find attached copies of the Code Enforcement Activity Reports for the
month of January:
(1) CEB Resolution, January 5, 2012
The resolution shows all the Code Enforcement Board actions and cases that
the Board has ruled on at their monthly hearing.
(2) Status Report Code Enforcement Inspections January, 2012
This report lists all inspections performed by individual staff for the month.
To be counted as an "inspection" a written "correction notice" must have
been issued as a result of the initial inspection.
(3) Code Enforcement Compliance Actions/Rental Inspections /Certifications
2011 -2012
This report lists the total number of residential rental dwellings, by district
(No. 1 -8), requiring inspection certification over the two year period noted.
Each rental unit inspected and certified as in compliance with minimum
habitability standards is marked "passed ". Those that do not pass the initial
inspection or require substantial repair are marked "failed ".

(4) Pasco Rental License Program: January- December 2012
This report tracks progress in the annual licensing of rental units. As of
February, 2009, we estimated that there were 5,788 rental units in the City.
As license applications and non- rental certifications are received, these units
are deleted from the figure of our original estimate of the total number of
rental units. As of January 31, 5,114 dwelling units have been licensed or
certified as non - rentals. This is over 88% of the estimated total.
January Code Enforcement /Rental License Program Highlights
In January, the City renewed our annual effort to locate and identify as many
unlicensed dogs in the City as possible. To do so, two temporary Inspection
Services Division staff are canvassing all residences in the City. As potentially
unlicensed dogs are located at these homes, the owners are provided licensing
information and advised that the dogs must be licensed by February 29. Through
January 31St, 7,020 residence were canvassed and approximately 1,016 unlicensed
dogs had been located by the canvassers. Basically, unlicensed dogs are being
found in roughly 14% of the homes visited.
The February report will be submitted on March 10, 2012. If you have any
