HomeMy WebLinkAbout02042010 Code Enforcement Board Resolution CITY OF PASCO CODE ENFORCEMENT BOARD RESOLUTION RESOLUTION NO. 2010 -2 i A RESOLUTION finding that code violations have been corrected and may be dismissed without penalty, deferring action on certain cases pending proper notification, accepting voluntary correction agreements, and assessing penalties on certain cases. WHEREAS, the City of Pasco has found that there exist conditions on certain properties that constitute violations of the Pasco Municipal Code; and WHEREAS, the Code Enforcement Board has the authority to affirm, dismiss, or modify notices of civil violations issued by the City: NOW IT BE RESOLVED BY THE CODE ENFORCEMENT BOARD OF THE CITY OF PASCO; That the following cases be dismissed without penalty: Service Repeat Daily Monetary CEB2009-0957 CARDER, JOHN M & MAR CEB2009-0982 KLITSIY, OLGA A& DEN CEB2009-0999 BERG, ZACHARIAH I CEB2009-1173 TABOADA, OSCAR A(ET j I CEB2010-0028 LAKKHAM, MARIA CEB2010-0029 RAMIREZ, ANTONIO&OLIVA CEB2010-0030 CONTRERAS, JASMIN B CE82010-0031 CARLSON, VALERIE P Be it further resolved the following people were not properly notified of alleged violations of the Pasco Municipal Code and hearings for their cases should be deferred until such times as they are properly notified: Service Repeat Daily Monetary CEB2009-1097 ROBERTS, KAREN L CEB2009-1105 LARSON, CAROL CEB2009-1166 RIOS, CESAR CE82010-0039 SCHELL, JACOB J & NALDA M 1 Be it further resolved that the Code Enforcement Board accepts or continues the below listed cases and voluntary correction agreements: Service Repeat Daily Monetary CEB2009-1087 GAYLORD REAL ESTATE LLC Be it further resolved that the following cases are now in compliance. However, proper notification of certain people required use of a professional process server and a monetary service penalty of thirty-five dollars ($35.00) is assessed in each case therefor; and certain properties and people were found in repeat violation of the Pasco Municipal Code and a minimum mandatory monetary penalty of two hundred dollars($200.00) is assessed for each repeat violation therefor; and certain properties and people were assessed a minimum mandatory monetary penalty of fifty dollars($50.00) for certain violation(s) of the Pasco Municipal Code therefor: Service Reheat Dailv Monetary CEB2009-1058 BERTELSEN, JEFFREY& Two Hundred Dollars ($200) Be it further resolved that the following people were properly notified of alleged violations of the Pasco Municipal Code but have failed to appear before the Pasco Code Enforcement Board for hearings on the date prescribed and said alleged violations have not been abated as required or were abated by the City and abatement costs, timeframes for compliance and daily monetary penalties in the amounts not to exceed those established by PMC 11.02.050 and as may be determined by the Community Development Director are assessed for each civil violation therefore: Service Repeat Daily Monetary CEB2009-0541 CORDIC, REFIK& FATIMA fifty dollars ($50) CEB2009-0909 ROJAS ROSAS, CEPORA fifty dollars ($50) CEB2009-1091 PRADO, HECTOR CEB2009-1113 VALDEZ, OFELIA two hundred dollars($200) one hundred dollars($100) CEB2009-1115 ZUCKER, GEORGE I fifty dollars ($50) CEB2009-1170 NUNEZ, MARTIN & MICA fifty dollars ($50) CEB2010-0004 SPINOZA, RUBEN G & KANDACE K fifty dollars ($50) CEB2010-0009 MARTINEZ, MANUEL two hundred dollars($200) one hundred doliars ($100) CEB2010-0034 FARRIS, JOANN four hundred dollars ($400) one hundred dollars ($100) Be it further resolved that the following people were properly notified of alleged violations of the Pasco Municipal Code and have appeared before the Pasco Code Enforcement Board for hearings on the date prescribed and the Board issued orders therefor: Service Repeat Daily Monetary CEB2010-0010 MORALES, RAFAEL two hundred dollars($200) one hundred dollars ($100) CEB2010-0037 MCGREEVY ENTERPRISES LLC two hundred dollars ($200) one hundred dollars ($100) 2 Total number of cases: 25 Passed by the Code Enfor ement Board of the City of Pasco this 4 of February, 2010 Daniel Gottschalk, Chairperson ATTEST: Mitch icko ds, nection Services Manager 3
