DETERMINATION OF HEARINGS Administration of Oaths Hearings Scheduled CEB2010-0447 8510 MASSEY DR-BARAJAS,LEONARDO&LAURA,owner Erin Roginski, Code Enforcement Officer Description:No garbage service at this address. (REPEAT)PMC 604.093 (1)Violation: Garbage containers must be stored behind the front set back line of the property and can only be placed at the curb no earlier than 7 pm the day prior to a scheduled garbage pick-up. The container must be removed from the street no later than 7 pm on the date of garbage collection. (2)Corrective Action: Store garbage can behind the front set back line of the property and place garbage container at the curb only during the approved times. CEB2010-0570 217 W CLARK ST-LEAL,ADOLFO,owner Martin Barajas, Code Enforcement Officer Description: Occupying un-inhabitable porch enclosure IPMC 108.1.4 (1)Violation: Allowing a structure that is found in whole or in part to be occupied by more persons than permitted under this code,or was erected,altered or occupied contrary to law. (2)Corrective Action: Any unpermitted occupancy must cease and that portion of the structure must be vacated.Remove alterations that allow un-permitted occupancy of porch,and any other common area. Description: Cockroach infestation throughout apartments IPMC 309.1 (1)Violation: Rental dwelling unit is infested with rodents or insects. (2)Corrective Action: Promptly exterminate rodents or insects by hiring an licensed professional.Provide proof of use of a professional exterminator and treat property and dwellings each six(6)months.Provide copies of application reports for City Review. Description:Insufficient garbage service PMC 6.04.090 CEB Agenda Pagel of 3 (1)Violation: Lack of sufficient garbage service for all tenants and units. (2)Corrective Action: Call Basin Disposal Inc.at(509)547-2476 to order sufficient garbage service for all tenants and units(i.e.3 yard container or 6 regular size cans). Description: Trash, litter, and debris scattered throughout property and in common areas PMC 9.60.030(10) (1)Violation: Trash,litter,rags,accumulations of empty barrels,boxes,crates,packing cases,mattresses,bedding,excelsior,packing hay,straw,or other packing material;lumber or scrap metal not neatly piled or anything which may be a fire danger. (2)Corrective Action: Remove and lawfully dispose of all trash,litter,and other debris which is not neatly piled and/or which is a fire danger. Description: Tall weeds along alley PMC 9.60.030(16) (1)Violation: Weeds,noxious weeds,grass,and other vegetation which constitutes a fire hazard,encroaches on sidewalks or neighboring properties,is damaging public improvements,impairs the vision of traffic signs or signals,and/or has reached a height of twelve inches(12"). (2)Corrective Action: Eradicate weeds by chemicals,cutting or other acceptable means so that they do not exceed twelve inches(12"), encroach on neighboring properties,constitute a fire hazard,etc. Weeds that are cut or removed by the root must be removed from the property and lawfully disposed of CEB2010-0580 3905 W ELLA ST-SMITH,ANGEL H(ETAL),owner Erin Roginski, Code Enforcement Officer Description:Pool is partially filled with stagnant water(REPEAT). IPMC 302.2 (1)Violation: Property has not been graded or maintained to prevent the erosion of soil or the accumulation of stagnant water on the property,or within the structure located on the property. (2)Corrective Action: Take proper measures to prevent the erosion of soil(i.e.landscape bare soil,etc.)or prevent the accumulation of stagnant water(i.e.don't run sprinklers so long,fill in low spots,etc.). Description:Accumulated dog feces in kennels in rear yard. PMC 9.60.030(6) (1)Violation: Any parcel within the City which is filthy,littered or trash-covered due to placing,dropping,disposing,throwing away, or otherwise discarding litter,garbage,refuse,cans,bottles,paper or paper material,metal,organic or inorganic material on areas of the property other than approved garbage containers. (2)Corrective Action: Remove and lawfully dispose of all litter,garbage,junk or vegetative waste on the property. PMC 9.56.030, 9.56.040 CEB Agenda Page 2 of 3 (1)Violation: Allowing blowing(fugitive)dust to leave the property. (2)Corrective Action: Treat all exposed and/or disturbed soils with an approved dust control treatment(i.e.hydro seed,mulch,landscaping, sprinkler,etc.)to prevent blowing dust from leaving the property. PMC 9.60.030(16) (1)Violation: Weeds,noxious weeds,grass,and other vegetation which constitutes a fire hazard,encroaches on sidewalks or neighboring properties,is damaging public improvements,impairs the vision of traffic signs or signals,and/or has reached a height of twelve inches(12"). MOTION: "I move that the Board approve Resolution No. 2010-07,as amended,finding that code violations have been corrected and may be dismissed, deferring action on certain cases until proper notification is made, accepting voluntary correction agreements, and assessing penalties and imposing time frames on certain cases."
