A copy of the 1999 agreement is attached hereto and incorporated herein by this reference. All terms and conditions of the prior agreement will remain the same except for: The City will make available to you a minimum of 17 hours of interpretation services per week instead of the 15 hours per week as stated in the prior agreement. If you are unavailable to interpret the minimum number of hours, you will then be paid only for the hours actually worked. This amendment modifying the previous agreement between yourself, as Interpreter, and the City of Pasco will take effect on February 28, 2005. Box 293, 525 North 3rd Avenue, Pasco, Washington 99301 June 18, 1999 Altagracia Escamila 1536 N. 18th Avenue Pasco, Washington 99301 Re: Interpretation Services Dear Ms. Escamila: This letter outlines the terms of the agreement between the City of Pasco and yourself for interpretation services for the Municipal Court. If you agree with these terms, please sign both originals, keep one for your files, and return one original to me. Altagracia Escamila (the Interpreter) will perform necessary interpretation services for the City's Municipal Court. The City will pay the Interpreter $35.00 per hour for interpretation services. The City will make available to the Interpreter a minimum of 15 hours of interpretation services per week. However, if the Interpreter is unavailable to interpret the minimum of 15 hours per week, the Interpreter will be paid only for hours actually worked. The Interpreter will bill the City on a regular basis for services rendered. The bills will be payable within 20 days of receipt. This agreement will continue in effect until terminated by either party on 45 days prior, written notice to the other party. All notices will be by certified mail. The Interpreter will not assign or transfer this agreement. This agreement expresses the entire agreement between the City and the Interpreter regarding this matter. This agreement can only be modified with another written agreement signed by both the City and the Interpreter. Both the Interpreter and the City agree that the relationship created by this agreement is that of an independent contractor and not that of employee and employer. The Interpreter is responsible for the payment of any taxes, including without limitation, all Federal, State and local personal and business income taxes, sales and use taxes, other business taxes and license fees arising out of the activities of the Interpreter. For the purposes of this agreement, time is of the essence. Should any dispute arise concerning the enforcement, breach or interpretation of this agreement, venue will be placed in Franklin County, Washington, and the laws of the State of Washington will apply.
