HomeMy WebLinkAbout4845 Ordinance - Amending 3.35.160 Water utility correcting formatting issues and clarifying applicable feesOrdinance – Amending PMC 3.35.160 Water utility to correct formatting and clarify applicable fees - 1 ORDINANCE NO. 4845 AN ORDINANCE OF THE CITY OF PASCO, WASHINGTON, AMENDING PASCO MUNICIPAL CODE SECTION 3.35.160 (WATER UTILITY) TO CORRECT FORMATTING, CLARIFY APPLICABLE FEES, AND REMOVE FEES NOT YET IN EFFECT, PROVIDING FOR SEVERABILITY AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, on January 20, 2026, the City Council adopted Ordinance No. 4804, which amended various water utility rates and connection fees, including establishing multiple future effective dates for certain fees; and WHEREAS, Ordinance No. 4804 included fees scheduled to take effect in 2026 and additional fees not scheduled to take effect until January 1, 2027; and WHEREAS, on March 16, 2026, the City Council adopted Ordinance No. 4824, which amended the water rights fee within the same section of code; and WHEREAS, the inclusion of multiple future effective dates within the same section of the municipal code, combined with amendments made by Ordinance Nos. 4804 and 4824, has resulted in confusion and formatting inconsistencies regarding which fees are currently in effect and their respective effective dates; and WHEREAS, the City desires to improve clarity, transparency, and ease of administration by removing some of the fees not yet in effect, establishing such fees through a separate ordinance at the appropriate time, and presenting currently effective fees in a clear and organized format. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. Severability. If any section, subsection, sentence, clause, phrase or word of this ordinance should be held to the invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any other section, subsection, sentence, clause phrase or word of this ordinance. Section 3. Corrections. Upon approval by the city attorney, the city clerk or the code reviser are authorized to make necessary corrections to this ordinance, including scrivener’s errors or clerical mistakes; reference to other local, state, or federal laws, rules, or regulations; or numbering or referencing of ordinances or their sections and subsections. This ordinance shall take full force and effect five (5) days after approval, passage and publication as required by law.
