A Street Application No. B23-2895 Dear Mr. Gonzalez: We are in receipt of the City of Pasco's request for comment on the proposed deferred payment of school impact fees for the above -referenced multi -family project (the "Project"), which we understand includes a total of 120 dwelling units. Our understanding is that the City of Pasco would process the deferred payment request consistent with the terms of PMC 3.40.070(2), and that the timing of payment of the deferred fees will be due consistent with PMC 3.40.070(2)(b). Based on the specific project details and our analysis of capacity projections at the schools that will serve the Project, the District is not opposed to the proposed concept of allowing the Project to defer payment of required school impact fees, However, we do not think that the City's current code provisions authorize the deferred payment option for multi -family development. Specifically, PMC 3.40.070(2), which provides the legal framework and authority for deferred payment of fees exclusively includes single-family residences within its reach. We are concerned about arbitrary application of the code provisions and resulting challenges, particularly if there is an attempted departure from any of the safeguards that apply to the deferred payment. Our concern is highlighted in that this Project is the second project in six months to request deferral of multi -family fees. As such, we prefer that the City amend its code to expressly include multi -family residences within the scope of PMC 3.40.070(2) to ensure uniformity of application of all provisions therein. Our support for this amendment reflects our agreement with the need for additional multi -family housing in our community and our shared desire to facilitate that delivery in a manner that does not compromise necessary public infrastructure. Please provide the District with a copy of the recorded lien for this deferral request. We appreciate the opportunity to provide these comments on the Project request, and that the City's code incorporates provisions for District input on similar requests. Specific factual circumstances related to proposals will be critical to allow the District to review potential capacity constraints and challenges that may result with a particular request. With this review, we can provide the City with an informed analysis that best addresses the needs of our students and our shared community. The Pasco School District appreciates the continued opportunity to work collaboratively with the City of Pasco to ensure that new residential development contributes to the costs of the school capacity needed to serve the development and relieve additional burdens on our shared taxpayers.
