8. PUBLIC COMMENTS - The public may address Council on any items
unless it relates to a scheduled Public Hearing. This item is provided to
allow the opportunity to bring items to the attention of the City Council or to
express an opinion on an issue. Its purpose is not to provide a venue for
debate or for the posing of questions with the expectation of an immediate
response. Some questions require consideration by Council over time and
after a deliberative process with input from a number of different sources;
some questions are best directed to staff members who have access to
specific information. Citizen comments will normally be limited to three

Verbal Reports from Councilmembers
Mr. Milne stated that he participated in Sue's Turkey Drive held the past weekend.
Mayor Barajas reported on another turkey giveaway that was sponsored by Door
Dash, Pasco Chamber of Commerce and Morning Star Baptist Church held on
Saturday, November 18th. She announced vacancies on the Arts & Culture
Commission and the Joint Housing Authority of the City of Pasco and Franklin
County and encouraged individuals to apply.
Ad Valorem Tax (Property Tax) and General Fund Revenue Presentation
Ms. Buckley introduced Franklin County Assessor John A. Rosenau who provided
an overview of the ad valorem tax (property tax) process.
Council and Mr. Rosenau briefly discussed the property tax process and where
the City is at this time.
Ms. Buckley provided report on the City of Pasco's general fund revenue and
provided three (3) options for Council to consider, which included taking no
increase, 1% thetaking or increase the (1%) one-percenttaking statutory
statutory increased and existing banked capacity.
Council and Ms. Buckley briefly discussed the proposed options for the 2024
property tax valuation.
ORDINANCES AND RESOLUTIONS NOT RELATING TO HEARINGS
Resolution Nos. 4401, 4402, and 4403 - Change Orders Nos. 22-27 for the
Lewis Street Overpass and PSA Amendments with J-U-B Engineers, Inc.

Management
Mr. Worley recapped the report previously given to Council at the November 13th
Workshop. He also addressed the comments received in the interim from last
week's Workshop. He confirmed that staff will continue to seek grants to help
offset the costs of the project.
Council asked for some clarification, discussed the reasons for the additional
costs associated with the project were due to a variety of reasons and ultimately
expressed support for this project.
MOTION: Mayor Pro Tem Brown moved, seconded by Councilmember Roach
to approve Resolution No. 4401, authorizing the City Manager to execute
Change Order No. 22-27 to the Construction Contract with Cascade Bridge,
LLC for the Lewis Street Overpass Project.
RESULT:Motion carried unanimously 6-0

Ordinance No. 4694 - Amending PMC Title 21 Related to Street Connectivity
Mr. Gonzalez provided a brief report on the proposed amendments to the Pasco
Municipal Code related to street connectivity.

Council and Mr. Gonzalez discussed the proposed amendments. Council
expressed appreciation for the efforts by many organizations to develop goals,
policies and best practices related to street connectivity.
Steve Bauman expressed disappointment in this process related to the proposed
street connectivity action stating that he did not hear about it since February 2023.
He stated that this will increase the cost of development.
MOTION: Mayor Pro Tem Brown moved, seconded by Councilmember
Campos to approve Ordinance No. 4694, amending Sections 21.05.020
“Purpose;” 21.05.030 “Application of this Title;” 21.05.040 “Exceptions;”
21.05.060 “Approval Required;” 21.10.020 “Terms Defined;” Chapter 21.15
“Streets;” and Section 21.20.010 “Block Length” and within Title 21 “Pasco
Urban Area Subdivision Regulations” of the Pasco Municipal Code and, further,
authorize publication by title only.
RESULT:Motion carried. 5-1

MISCELLANEOUS DISCUSSION
Mayor Barajas commented on the photos taken at the recent turkey giveaway event.
Mr. Lincoln reported on the Washington State Transportation Commission meetings
that the City of Pasco hosted during the past week.
Mr. Rice announced the Wreaths Across America event scheduled on December 16th
at City View Cemetery, Winterfest is scheduled for December 6th at Peanuts Park,
the 45th Annual Lampson Cable Bridge Run is scheduled for December 16th, and
City Hall will be closed on Thursday, November 23rd and Friday, November 24th in
observance of the Thanksgiving holiday.
Mr. Campos asked Deputy Police Chief about traffic accidents located on 20th
Avenue crosswalk controlled a suggested and Super Mex forthe near store
pedestrians at that location.

PUBLIC COMMENTS
Jet Richardson, Habitat for Humanity Executive Director, expressed support for the
proposed Ordinance No. 4700 amending the Pasco Municipal Code related to
residential design standards for affordable housing. He suggested that the City
provide clarification related to the land use coverage, under the 40 to 60 percent. He
also expressed support for water saving landscaping requirements.
Kim Lehrman, Pasco resident, expressed appreciation to Mayor Pro Tem Brown for
his service on the Council. She requested that the ad hoc Inclusion, Diversity and
Equity Commission by reinstated.

Public Hearing and Ordinance No. 4695 - Ad Valorem Tax (Property Tax) and
General Fund Revenue Presentation
Ms. Buckley provided a brief report related to the proposed 2024 Ad Valorem and
stated that staff recommends Option B with taking the one-percent (1 %) increase
to cover additional activities related to the Animal Control Shelter, the recent
addition of the Pasco Specialty Kitchen and Pasco Farmers Market, as well as
debt service that was/will be issued.
Mr. Serrano asked what was Council's decisions related to property tax the past
three to five years.
Ms. Buckley and Ms. Sigdel responded that Council last took the banked capacity
in 2018 for 2019 collection.
Mayor Barajas declared the Public Hearing open to consider the proposed 2024
Ad Valorem Tax for the City of Pasco.
Following three calls for comments, and there being none, Mayor Barajas
declared the Public Hearing closed.
MOTION: Councilmember seconded moved, Brown by Pro Mayor Tem
Serrano to adopt Ordinance No. 4695, providing for an increase in the regular
property taxes of the City for levy in 2023 and collection in the 2024 tax year;
preserving the levy capacity for future years: and providing for related matters.
[Zero-Percent (0 %) increase from the previous year, 2023]
RESULT:Motion defeated by Roll Call Vote. 1-6

Public Hearing and Ordinance No. 4696 - 2023-2024 Proposed Mid-Biennium
Budget Adjustment
Ms. Sigdel introduced the proposed 2023-2024 Mid-Biennium Operating Budget
Adjustment noting that this is the opportunity to make changes to the budget
assumptions based on a variety of prudent reasons.
Ms. Buckley provided the highlights of the 2023-2024 Operating Budget
adjustments.
Mr. Serrano asked about the Real Estate Excise Tax (REET) and asked if there
were any other funds that the City needs to be mindful of.
Ms. Buckley responded that staff continually evaluates all revenue sources and
expenses, using various local, state and federal economic factors to ensure
adjustments when needed are addressed.
Ms. Roach asked if the utility funds mingle with the General Fund and does the
City make a profit from the utility funds.
Ms. Buckley confirmed that the utility funds and General Fund are separate. The
City does not make a profit from utility fees. She stated that the City will complete
rate studies periodically to ensure the utility fees are set to cover the utility costs.
Mayor Barajas declared the Public Hearing open to consider the proposed
adjustment to the 2023-2024 Mid-Biennium Operating Budget.
Following three calls for comments, and there being none, Mayor Barajas
declared the Public Hearing closed.
MOTION: Mayor Pro Tem Brown moved, seconded by Councilmember Blasdel
to adopt Ordinance No. 4696, amending the 2023-2024 Biennial Operating
Budget by providing supplement thereto; by appropriating revenue received in
excess providing by and Biennial current for revenues estimatedof the
transfers and adjustment authority and, further, authorize publication by title
only.
RESULT:Motion carried unanimously 7-0

Ordinance Nos. 4698 & 4699 - 2024 Administrative/Professional Wage and
Management Salary Plans
Ms. Sigdel provided a brief report related to the 2023 non-represented groups
comprising of administrative/professional and management wages and salary
plans.
Ms. Roach commented that when the City is fully staffed that the compensation
studies be completed in-house
Mr. Serrano asked if the City did a sample wage/salary study locally and/or
regionally.
Ms. Sigdel confirmed that a review was completed and that some municipalities
use different compensation processes.
MOTION: Mayor Pro Tem Brown moved, seconded by Councilmember Roach

MISCELLANEOUS COUNCIL DISCUSSION
Mayor Barajas announced that this was the last meeting for Mayor Pro Tem Brown
and Councilmember Campos. She expressed appreciation for their service to the City
of Pasco as Councilmembers.
Mr. Milne expressed appreciation to Mayor Pro Tem Brown and Councilmember

Campos for their work together and friendships.
Mr. Serrano expressed appreciation to both Mayor Pro Tem Brown and
Councilmember Campos for their time on Council and for their viewpoints, which
provided for richer discussions on certain topics.
Ms. Roach stated that both Mayor Pro Tem Brown and Councilmember Campos will
be missed on Council and appreciated their skill sets that they brought to Council.
Ms. Blasdel expressed appreciation for Mayor Pro Tem Brown and Councilmember
Campos as they were very welcoming when she was appointed in October 2023.
Mr. Lincoln commented on how Mayor Pro Tem Brown and Councilmember Campos
made themselves available to the public and were dedicated to their positions on City
Council. He stated that it was a honor to work with each of them.
Mayor Pro Tem Brown expressed gratitude to Council, staff and the residents at large
during his time on City Council. He asked the reinstatement of City's ad hoc Inclusion,
Diversity and Equity Commission.
Mr. Campos stated that no one knows what is involved in serving on City Council. He
said that it carries a sacrifice to do the job well.

IV. HISTORY AND FACTS BRIEF:
In August 2016, the Pasco City Council approved Ordinance No 4311, which
included a vacation of the right-of-way as depicted in Exhibit 1 (refer to
attached Ordinance No 4311). The legal description of the vacation did not
encompass anto leading 4311,No Ordinance in depicted area the
inconsistency of the right-of-way along North Wyoming Avenue along the full
length of the subject property.
In May 2023, K&S Family Enterprises, LLC submitted a foundation permit
application for the construction of a 12,000 square-foot warehouse shop
addition. On May 11, 2023, the Planning Division issued a review note stating
that the vacation of this section of Wyoming Avenue street Right-of-Way should
occur and Building granted. is Certificate of site the before Occupancy
improvements are to be permitted separately.

In response to this review note, Kim Mickelson, representing K&S Family
Enterprises, LLC, submitted a petition on July 19, 2023, requesting the
vacation of a 10' X 40' portion of North Wyoming Avenue right-of-way in Frey's
Addition.
Staff processed the petition in accordance with requirements of Pasco
Municipal Code 12.40.030.
On November 6, 2023, City Council passed Resolution No. 4389, setting
December 4, 2023, as the date for a public hearing to consider this vacation
request.
V. DISCUSSION:
As discussed in the History and Facts Brief, the Pasco City Council approved
Ordinance No. 4311 in August 2016 with the intent of vacating the subject
property, but upon later examination the legal description did not fully
encompass the intended vacation area. This vacation is intended to address
this oversight.
Per Pasco Municipal Code (PMC) 12.40.070, The City Council shall use the
following criteria for approval of the petition:
(1) The vacation shall not adversely affect traffic accessibility and circulation
within the immediate area or within the City as a whole;
Staff Determination:
The proposed vacation will help provide right-of-way continuity along North
Wyoming Avenue, as was previously intended by Ordinance 4311.
(2) The right-of-way is not contemplated or needed for future public use;
Staff Determination:
The City has reviewed the vacation petition and finds no need for future public
use of the proposed vacated right-of-way.
(3) No abutting property will become landlocked, or its access substantially
impaired; and
Staff Determination:
The proposed vacation will not landlock or impair access to any properties.
(4) The public needs shall not be adversely affected and the vacation will

provide a public benefit or serve a public purpose.
Staff Determination:
No adverse effects are contemplated from the proposed vacation; the public
will benefit from right-of-way continuity along the west edge of North Wyoming
Avenue.
In evaluating the requested street right-of-way vacation in accordance with
Pasco Municipal Code (PMC) Section 12.40.070(1)-(4), the staff analysis
concludes not does and criteria requisite satisfies vacation the that the

area is not associated with any projects or programs outlined in the approved

AN ORDINANCE OF THE CITY OF PASCO, WASHINGTON,
VACATING A PORTION OF NORTH WYOMING AVENUE RIGHT-OF-WAY
IN FREY'S ADDITION TO PASCO, WASHINGTON.
WHEREAS, from time to time in response to petitions or in cases where it serves the
general interest of the City, the City Council may vacate rights-of-way (ROW); and
WHEREAS, a petition for vacating a portion of North Wyoming Avenue right- of-way in
Frey's Addition to Pasco has been submitted to the City by owners of more than two-thirds of the
properties abutting the portion of the right-of-way to be vacated per Pasco Municipal Code (PMC);
and
WHEREAS, on November 6, 2023, pursuant to the PMC Section 12.40.040, the City
passed Resolution No. 4389, setting a public hearing for the proposed vacation; and
WHEREAS, pursuant to PMC Section 12.40.050, appropriate notice was given of the
public hearing related to possible vacation of the public right-of-way; and
WHEREAS, the City held a public hearing on the proposed vacation on December 4,
2023; and
WHEREAS, the vacation process provided in PMC Chapter 12.40 requires a title report,
and an appraisal of value and compensation unless waived by the City Council; and

WHEREAS, pursuant to PMC Section 12.40.120(2) the City may waive the requirement
for a title report, an appraisal of value and compensation if one or more of the following are
applicable: the vacation is initiated by Council Resolution; the vacation is at the request of the
City; the Council had previously determined that the right-of-way is not essential to public traffic
circulation and is available for vacation; the grant of a substitute right-of-way has value as a right-
of-way at least equal to the right-of-way to be vacated; or the resulting benefit to the community
of the project requiring the vacation outweighs the appraised value of the right-of-way to be
vacated; and
WHEREAS, the proposed vacation does meet the above listed criteria for waiver of the
requirements for a title report, an appraisal of value, and compensation pursuant to PMC Section
12.40.120(2)(e) as it was acquired without cost to the City and the resulting benefit to the
community, in terms of increased traffic safety as a direct result of safer turn radius, will outweigh
any value of the vacated right-of-way; and
WHEREAS, the City Council may approve a right-of-way vacation upon making findings
pursuant to PMC Section 12.40.070(1)-(4), that the vacation of the right-of-way will not adversely
affect traffic accessibility and circulation within the immediate area or with the City as a whole; is
not contemplated or needed for future use; no abutting property will become landlocked or have
access substantially impaired; and the public needs shall not be adversely affected and the vacation
will provide a public benefit or serve a public purpose; and
WHEREAS, the City Council finds that the required criteria of the PMC Section
12.40.070(1)-(4) have been met; and
WHEREAS, all steps and procedures required by law to vacate said right-of-way have
been duly taken and performed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. That a portion of right-of-way, as described below and as depicted in
Exhibit A be and the same is hereby vacated;
That portion of North Wyoming Avenue right-of-way in Frey's Addition to Pasco
according to the plat thereof recorded in Volume " B" of plats at page 16, records
of Franklin Co, Washington being described as follows:
A strip of land lying 40.00 feet north of the southerly right-of-way line of vacated
Trinidad Street and 10. 00 feet east of the westerly right-of-way line of North
Wyoming Avenue, together with and subject to easements, reservations, covenants
and restrictions of record and in view.

Section 2. That the City shall retain an easement and the right to exercise or grant
easements adjacent to North Wyoming Avenue.
Section 3. That pursuant to PMC Chapter 12.40, the City Council does hereby waive
the requirements for an appraisal, title report, and compensation for the vacated right-of-way.
Section 4. That a certified copy of this Ordinance be recorded by the City Clerk of the
City of Pasco in and with the office of the Auditor of Franklin County, Washington.
Section 5. Severability. If any section, subsection, sentence, clause, phrase, or word
of this Ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction,
such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any
other section, subsection, sentence, clause, phrase, or word of this Ordinance.

In 2004, the Cities of Kennewick, Pasco, and Richland established the Tri-
Cities Regional Hotel/Motel Commission (Commission), at the behest of Visit
Tri-Cities, to create a Tourism Promotion Area (TPA). This TPA aims to boost
hotel usage in the Tri-Cities, funded by a special hotel industry assessment,
initially set at $1.50 per night in 2004, increased to $2 in 2014, and currently $3
since late 2020.
Each increase in assessment was supported by the Commission. Each city
collects TPA charges monthly through an agreement with the Washington
State Department of Revenue (DOR), which are then transferred to Visit Tri-
Cities for administration of the Regional TPA.

In September 2023, Pasco, along with numerous TPAs across the state and
including neighboring Richland and Kennewick, was notified by DOR of non-
compliance with state law in its TPA municipal code. DOR proposed a
temporary agreement to continue TPA charge collection through 2024, giving
these jurisdictions time to make adjustment to bring their municipal codes to
compliance or seek legislative action to modify state law.
We recommend approving the temporary DOR agreement for TPA charge
collection for the year 2024. Staff will collaborate with Visit Tri-Cities, and the
Cities of Richland and Kennewick to resolve this issue.

City of Pasco and Washington State Department of Revenue as attached hereto and incorporated
herein as Exhibit A; and to make minor substantive changes as necessary to execute the
Agreement.

TEMPORARY AGREEMENT FOR THE STATE ADMINISTRATION OF
TOURISM PROMOTION AREA FEES WITH THE CITY OF PASCO
THIS AGREEMENT (“Agreement”) is entered into by and between the City of Pasco (“City”)
and the State of Washington Department of Revenue (“Department”) for the administration of
the tourism promotion lodging charges imposed under authority of RCW 35.101.052. This
Agreement is effective December 1, 2023
RECITALS
WHEREAS the Legislature of the State of Washington by chapter 35.101 RCW
authorizes a legislative authority, either singularly or through an interlocal agreement with other
jurisdictions, to establish a Tourism Promotion Area (“TPA”) to permit the levy of lodging
charges to be expended exclusively for tourism promotion;
WHEREAS chapter 35.101 RCW provides that a legislative authority imposing a lodging
charge by resolution or ordinance shall contract with the Department for the administration and
collection of the levy of lodging charges;
WHEREAS the legislative authority has by ordinance, copy attached hereto, indicated its
intention to fix and impose a lodging charge in addition to all other sales and use taxes and any
special assessments that may be levied (Ordinance No. 4507);
WHEREAS Ordinance No. 4507 provides exclusions from the TPA lodging charge
which are not permitted under state law, including: (i) trailer camps and recreational vehicle
parks which charge for the rental of space to transients for locating or parking house trailers,
campers, recreational vehicles, mobile homes, and tents; (ii) educational institutions which sell
overnight lodging to persons other than students; (iii) private lodging houses, dormitories and
bunkhouses operated by or on behalf of businesses and industrial firms or schools solely for the
accommodation of employees of such firms or students which are not held out to the public as a
place where sleeping accommodations may be obtained; and (iv) guest ranches or summer camps
which, in addition to supplying meals and lodging, offer special recreational facilities and
instruction in sports, boating, riding, outdoor facilities and instruction in sports, boating, riding,
and outdoor living;
NOW, THEREFORE, to provide for the administration of lodging charges, the parties
agree as follows:
AGREEMENT
1. Incorporation of Recitals. The above recitals are true and correct and are incorporated
herein by this reference as if fully set forth.
2. Functions of the Department. The Department shall exclusively perform all functions
incident to the administration and collection of the lodging charges imposed by Ordinance No.
4507 taxable by the state under chapter 82.08 RCW.

The Department will collect TPA charges described under Ordinance No. 4507 until December
31, 2024, to allow the City or any other party to seek corrective legislation to chapter 35.101
RCW, or to permit local jurisdictions to adopt exclusions according to their unique geographic
and economic needs.
In the event corrective legislation is not enacted by December 31, 2024, the City shall amend
Ordinance No. 4507, or adopt another ordinance which does not include exclusions not permitted
under existing state law. The Department will not enter into a new agreement to collect the TPA
charges for the City until the nonconforming ordinance is cured.
3. Collection Not Authorized. Pursuant to RCW 35.101.050, the Department is not
authorized or required to administer and collect on behalf of the City any charge for which there
are more than six classifications.
4. New or Additional Legislation. In addition to the Ordinance attached hereto, the City
shall provide the Department with copies of any new and/or additional ordinances imposing any
new charges or changing the rate of any charge. Such copies shall be provided to the Department
no later than 75 days prior to the effective date of the ordinance.
5. Collection of Lodging Charges. The Department shall collect the lodging charges by the
end of the following month after the due date of the taxable period for which lodging charges are
imposed pursuant to the ordinance. In accordance with RCW 35.101.090, the charges so
collected shall be deposited by the Department in the local tourism promotion account in the
custody of the state treasurer. The Department shall provide the state treasurer with instructions
on the proper monthly distribution of the deposited funds in accordance with RCW 35.101.100.
6. Rules and Regulations Adopted by the Department. Any specific rules and regulations
adopted by the Department to facilitate the administration and distribution of the lodging charges
shall be in accordance with the State Administrative Procedure Act and chapter 35.101 RCW.
Until specific rules and regulations are adopted, the Department shall apply the provisions
contained in chapters 82.03, 82.08, 82.12, 82.14, and 82.32 RCW, as the same exist or may
hereafter be amended and insofar as the same are relevant to lodging charges. Such provisions
shall have full force and effect of Department rules when applied to lodging charges.
7. Uniform Collection. The Department performs its duties hereunder so that as far as
possible the lodging charges shall be administered and collected uniformly with the state’s sales
and use taxes.
8. Refunds or Credits. Any refunds or credits the Department finds are owed relating to
the lodging charges shall be refunded to the taxpayer from the City’s portion of the local tourism
promotion account.
9. Notification of Error of Fund Distribution. Either party shall have six months from the
date funds are distributed by the state treasurer to notify the other party in writing of any error in
the amount of distributed funds. The party receiving such notice shall have sixty (60) days to

review the claim. Upon agreement of the parties, the Department shall deposit any necessary
additional funds with the state treasurer for distribution to the City; or in the event of an over-
distribution, the City shall return such over-distribution to the Department. If the City and the
Department cannot reach an agreement, the parties agree to attempt mediation or other dispute
resolution process prior to instigating litigation in Superior Court.
10. Disclosure of Taxpayer Information, Documentation and Reports. The Department
shall provide taxpayer information, documentation, and reports to the City, in accordance with
the disclosure limitations of RCW 82.32.330. The City shall require its authorized
representatives that have access to confidential taxpayer information to sign a Department
"Confidentiality and Non-Disclosure Agreement" and shall ensure such representatives comply
with RCW 82.32.330.
11. Parties’ Communication and Cooperation. The parties agree to establish and maintain
open lines of communication and to work cooperatively to improve administration and public
understanding of the lodging charges (special assessments). Either party may initiate a meeting,
to be held at a mutually convenient time and place, to share information and to discuss matters
related to administration and collection of the lodging charges.
13. Disputes. In the event a dispute arises under this Agreement that cannot be resolved by
mutual agreement of the parties, either party may elect mediation in which the Department and
the City shall each individually appoint one member to a Dispute Board and those members shall
select a third member. The Dispute Board shall evaluate the dispute and make a written
determination after considering the relevant facts and legal authorities. The Dispute Board’s
determination shall be given significant weight by both parties who will meet after the
determination is issued to resolve the dispute. If a resolution is not reached, the determination of
the Dispute Board shall be admissible in any future legal proceeding between the parties
concerning the dispute. Each party shall be responsible for a proportionate share of the costs of
the member of the Dispute Board. This remedy is not intended to be exclusive of other remedies
existing in law, by statute, or otherwise.
No suit, action, or proceeding of any kind, type, or nature whatsoever arising out of or in any way
relating to this Agreement will be commenced by the City or the Department other than in the
Superior Court of Thurston County, Washington.
14. Indemnification. To the extent permitted by law, the City agrees to indemnify, defend,
and hold harmless the Department for the State of Washington from claims that challenge the
authority of the City to impose lodging charges pursuant to the Ordinance. The City agrees that
in the event there shall be a legal challenge to the Ordinance or resolutions, the Department shall
not be obligated to represent the City or otherwise defend its position in any proceeding relating
to such challenge.
15. Effective Date. This Agreement shall take effect at 12:01 AM, December 1, 2023 and
shall thereafter terminate on December 31, 2024.

16. Waiver. Any failure by any party to insist upon strict performance of any provision of
this Agreement shall not be deemed a waiver of the right to require future strict performance of
such provision. No failure or delay in exercising any right or remedy hereunder shall be deemed
a waiver of such right or remedy. No term or condition of this Agreement shall be waived,
modified or deleted except by an instrument, in writing, signed by personnel authorized to bind
each of the parties.
17. Modification. This Agreement may be amended by mutual agreement of the parties.
Such amendments shall not be binding unless they are in writing and signed by personnel
authorized to bind each of the parties. The parties to this Agreement will notify each other in a
timely manner when they find it necessary to request an amendment to this Agreement.
18. Entire Agreement. This Agreement contains all the terms and conditions agreed upon by
the parties. No other understandings, oral or otherwise, regarding the subject matter of this
Agreement shall be deemed to exist or to bind any of the parties hereto.
19. Counterparts. This agreement may be executed in two or more counterparts, each of
which shall be deemed an original and which together constitute one and the same.

IV. HISTORY AND FACTS BRIEF:
State law authorizes the collection of the 2% local tax on lodging facilities
(hotels and motels). The funds originally could be used for stadiums and for
tourism promotion activities. In 1993, like several cities prior to that time, Pasco
was granted by State law authority to assess an additional 2% lodging tax fund
specifically the City's share of TRAC, currently known as HAPO Center.
The legislature subsequently increased the base lodging tax to 4% and
eliminated the individual taxing authorizations. The amendment also required
the establishment of a Lodging Tax Advisory Committee (LTAC) to review and
recommend proposed uses of the lodging tax annually.
V. DISCUSSION:
The Pasco LTAC convened on September 5, 2023, to review thirteen (13)

proposals received for use of the 2024 Lodging Tax receipts. Requests
received totaled over $1.05M while projected revenue is $850K. Staff
recommended to fund the Gesa Stadium Bond Debt from the Stadium Fund
Balance, which remains healthy. This recommendation brings requests to
$791K, within projected revenue.
Based on the Committee's review of allowable uses and individual requests,
the LTAC recommends fund allocations as outlined below:

investment in community infrastructure including, but not limited to:
x Completion of Transportation System Master Plan and design standard updates to promote greater
neighborhood cohesion in new and re-developed neighborhoods through design elements, e.g.;

Promote proactive approaches for the strategic investment of infrastructure, staffing, and equipment
including, but not limited to:x Adoption and develop implementation strategies for Comprehensive Fire Master Plan aimed at maintaining the
current Washington State Rating Bureau Class 3 community rating.
x Collaboration with regional partners to influence strategies to reduce incidences of homeless by leveraging
existing resources such as the newly implemented 0.1% mental health sales tax, use of resource navigator
programs, and other efforts.
x Development of an implementation strategy for the Comprehensive Police Master Plan to support future service
levels of the department to assure sustainability, public safety, officer safety, crime control, and compliance
with legislative mandates.

Promote and encourage economic vitality including, but not limited to:
x Implementation of the Comprehensive Land Use Plan through related actions including zoning code changes,
phased sign code update, and development regulations and standards.
