V1.1 11/19/21 $r Agreement For Obtaining Credit Reports For Employment Purposes Account Number: AGREEMENT End -User and Employment Screening Services, Inc. (ESS, Inc.) agree to the following: 1. This Agreement is made by and between Employment Screening Services, Inc. (ESS, Inc.), and End -User of credit bureau products and identifies the conditions under which credit reports and identification reports will be provided to End -User. 2. This the Agreement for Consumer Reports for Employment Purposes is long that agreement conjoins with and valid only as as agreement remains in effect. 3. Reseller (ESS, Inc.) has access to consumer reports from one or more consumer credit reporting agencies. 4. End -User is seeking consumer information in connection solely with the evaluation of individuals for employment, promotion, reassignment, or retention as an employee. 5. End -User agrees to comply with the Fair Credit Reporting Act (FCRA 15 U.S.C. § 1681) and any applicable local, state and federal laws. 6. End -User understands and agrees to the limitations that some states have on the use of credit reports for employment purposes as explained in addendum C of this agreement. 7. End -User understands and agrees to abide by the access security requirements as explained in addendum A of this agreement. 8. End -User agrees it will not request a Consumer Report or Investigative Consumer Report from ESS, Inc. unless a disclosure has been made to the consumer that a report may be obtained, and the consumer has authorized the report in writing. The disclosure must include a statement informing the consumer of his/her right to request additional disclosures. The disclosure will be made on a separate document, consisting solely of the disclosure and written authorization. 9. End -User agrees that before taking adverse action in whole or in part based on a Consumer Report as per The Fair Credit Reporting Act (FCRA, 15 U.S.C.§ 1681 et seq. Section 604), it will provide the consumer: (A) Oral or written notification of the identity of the consumer reporting agency and a statement that the agency did not make the employment decision; (B) A copy of the consumer's rights; (C) A copy of the consumer report. 10. End -User agrees it will not request an Investigative Consumer Report on a California resident unless notification is given to the applicant/employee stating that a report will be obtained. The End -User further agrees to give the individual a copy of the report within three days of receiving the report, if requested by the individual (per CA Civil Code 1786.) 11. End -User shall comply with the Vermont Fair Credit Reporting Act, 9 V.S.A. § 2480e, by securing the written consent of the Consumer prior to ordering a consumer report on a Vermont resident. 12. End -User agrees not to resell or sub -license the information to any third party. 13. End -User understands that due to credit bureau policy it may not obtain credit reports or identification reports from ESS, Inc. if it is: a private detective, private detective agency, private investigative company, bail bondsman, attorney, law firm, credit counseling firm, security service, member of the media, reseller, financial counseling firm, credit repair clinic, pawn shop (except that companies that do only Title pawn), check cashing company (except companies that do only loans, no check cashing), genealogical or heir research firm, dating service, massage or tattoo service, business that operates out of an apartment, an individual information for their own private use, an adult entertainment service of any kind, company that locates missing children, company that handles third party repossession, company seeking information in connection with time shares, subscriptions company, individual involved in spiritual counseling or a person or entity that is not an End -User or decision maker; unless written approval has been obtained from the credit bureaus prior to ordering credit or identification reports. 14. With just cause, such as delinquency or violation of the terms of this contract or a legal requirement, or a material change in existing legal requirements which adversely affects this Agreement, ESS, Inc. may, upon its election, discontinue serving End - User and cancel this Agreement immediately. 15. End -User will hold ESS, Inc. and all its agents, including all credit bureaus, and vendors of records harmless of any expense or damage arising or resulting from the publishing or other disclosure of Consumer Credit Information by End -User, its employees or agents. 16. End -User agrees that it shall use Consumer Reports for Employment Purposes only for a one-time use, and to hold the report in strict confidence, and not to disclose it to any third parties not involved in the current employment decision. 17. End -User will maintain copies of all written authorizations for a minimum of five (5) years from the date of inquiry. 18. End the FCRA that knowingly information on -User recognizes and understands provides anyone who and willfully obtains a consumer from a consumer reporting agency (such as ESS, Inc.) under false pretenses shall be subject to penalties under Title 18, United States Code. 19. The term of this Agreement shall begin on the date it is executed by End -User and will continue for a period of one (1) year from that date, unless earlier terminated in writing. This Agreement will renew automatically for successive one (1) year periods unless either party gives written notice to the other party of its intent to terminate the Agreement. 20.
