C�evel�pment and Consulting FINDINGS: 9/13/22—(included in agenda packet)JefFAdams (Planner 1)wrote an email to Steve West (Property Owner) — "Because this project is within a Washington State Department of Transportation (WSDOTJ right-of-way it is most likely you will be dealing with WSDOT for this ROW acquisition (!have copied WSDOT P/anning Engineer Paul Gonseth on this emailJ. As such, WSDOT would decide if ROW would need to be purchased." 9/16/22—(included in agenda packet) Paul Gonseth, PE (WSDOT) wrote— "We have reviewed the Vacation request and find this property is not needed for the current or future operation of the City Street(SR 397). Therefore, the Washington State, Department of Transportation approves the Vacation Request. WSDOT has alsv reviewed our records and found thar the State did not contribute any funds to acquiring this property. So, all revenue derived from the vacation of such rights-of-way shall be the City's." 9/27/22-Steve West received an invoice from PBS for survey work and copies of said work for the property in question provided in the agenda packet is the survey work paid by Steve West in the amount of$2,272.75 12/5/23—City Council had its first public hearing regarding ROW and voted to continue the hearing. 2/13/23—City Council workshop approved a discussion where Rick White stated that the concerns of the property owner may be addressed administratively. 2/21/23—John Scheline (64) sent an email saying, "Is there anything we can be doing to help that process along? We are more than willing to help in any way but want to make sure we can keep moving forward." Subsequent emails show a desire to communicate with the city and often a lack of response and/or willingness to find solutions. PMC 12.40.070 1) Vacation shall not adversely affect traffic accessibility and circulation within the immediate area or within the City as a whole. a. Traffic would not be adversely irnpacted, and accessibifity wou/d be mitigated. 2) The right of way is not contemplated or needed for future public use a. Acenrding to WSD07"the property is not needed for rhe current or future operation of the City Street. 3) No abutting property will become landlocked,or its access substantially impaired; and a. NO impact on r�eiqhboring or abutting parcels. 4) The public needs shall not be adversely affected,and the vacation will provide a public benefit or serve a public purpose. a. I want to take a bit to delve deeper into my investigation and discovery but felt it would be beneficial to send you Steve's proposed site plan of kind of what he sees going on the site. Steve West has expressed the need for access off Oregon Street, matching the 1 � same access on the west side. He has expressed to me his willingness to cooperate with the city in order to find a fair and equitable solution that will contribute to the improvement of the land. It is imperative that we ensure that the small parcel owned by the city does not become a wasteland or a nuisance property. We would like to come to a solution that includes access off of Oregon Street and the city's ability to still maintain access for the ROW when/if needed. Subject: RE: Oregon&A Street ROW John, I wanted to share with you that I had a conversation with Steve West several months ago about this issue. I told Steve that I could not support vacating the right-of-way at this intersection because with all the developments planned along A Street to the east,the City doesn't know if future improvements to the intersection will be needed. And it would not be prudent for the City to vacate ROW just to have to buy it back in the future should an intersection improvement project be needed to accommodate other developments in the area. And the City won't know if any improvements will be needed until all future developments along A Street are known and traffic impacts are determined. Steve West subsequently asked if the City could grant a license agreement for use the right-of-way area. I asked Steve what the proposed use would be for (thinking it would be for landscaping or something similar). Steve said it would be for additional parking stalls. I told Steve I could not support that idea because if future intersection improvements are needed,the City would be put in a position to have to remove those parking stalls and likely have to compensate the owner/lessor for the reduced parking area, which impacts businesses. I mentioned to Steve that I've been through that scenario before, parking stalls and business impacts are expensive, and I don't want to put the City in a position to have to go through that. I believe City staff has been pretty clear that the vacation or licensing use of that corner right-of-way is not something the City is interested in entertaining at this time. The bottom line is Steve would like to build a commercial business that would like to have access to Oregon and A Street. There is a small ROW at the corner that he is requesting to have vacated. It was once owned by DOT and DOT said they could not give it to Steve but could give it to the City and the City could in turn give it to Steve. I am 3 � happy to give more insight into our request if this has fallen through the cracks but we have been wrestling through this for months seemingly unsuccessfully. Steve West has done everything requested from the City including paying PBS Engineering for documents that he has handed over to the city and he has not been compensated and also has not been given access to this ROW in question. We really need to finalize this and are at a loss as to why it is taking so long. Please help us move this to a successful conclusion. I'm sure you're also aware that staff is against vacation because of the distinct , possibility that the r/w may be needed in the future. Because of notice requirements we have penciled in April 3 as the as the next date for Council to consider the request. I know that Dave (?) Bruce has expressed concern about maintaining r/w but I'm not seeing that as something that is a deal killer. Has the site plan originally handed out at a council meeting been refined? - Rick W Additionally, Rick,you mentioned in the ELT yesterday that there was some idea out there about possibly retaining"an easement" in case the City needs to use the potentially vacated land in the future � for a road. I'm not sure if it is helpful, but I do NOT think that is an option. The statute and our code are very specific—the only easements that can be retained have to be for specific purposes(i.e. not as a road),and,one of the criteria that Council has to use to decide if the vacation should be approved is that it is NOT anticipated that it will be needed in the future,otherwise,the City has to retain th� ROW. Please see highlighted sections of the PMC below. I included Steve W.and Adam since it sounds like they have been involved in the discussion about the easement. 12.40.070Criteria. He noted that staff recommends denial of this request. Council briefly discussed the proposed vacation and the possible use of the land to accommodate for traffic needs in the future. Mayor Barajas declared the Public Hearing open to consider the proposed right-of- way vacation for Snake River Agriculture, LLC. Steven Bauman, Snake River Agriculture representative, explained that the owner of the proper#y plans build a gas station on the property. He requested that Council approve the right-of-way vacation and sugges#ed that the City may retain a roadway easement if need be. Following three calls for comments, and there being none, Mayor Barajas declared the Public Hearing closed. Council and staff continued discussion of�he possible need for the future use of the right-of-way and requested that this item be continued with additional information that could accommodate both the City and the applicant. MOTION: Mayor Pro Tem Maloney moved, seconded by Councilmember Roach to continue the right-of-way vacation for Snake River Agriculture, LLC (VAC 2022-006)to the Council Workshop scheduled for February 13, 2023. ITEMS FOR DISCUSSION Housing Authority Interlocal Agreement Mr. White introduced Housing AutF�ority of the City of Pasco and Franklin County Executive Director Matt Truman who then provided a brief presentation regarding Housing Authority statistics, community partnerships, Varney Court and requested the In#eriocal Agreemen#between the Gi#y and#he Housing Aut#�orit�regarding #t�e Pilot Tax be removed from the affordable housing program. Council and Mr. White continued to discuss affordable housing options including Single Room Occupancy, intentions of presenting the Housing Authority to the Pasco School District an other agencies involved with the Pilot Tax. I P��81�8 Presentation - Processars Wastewater Treatment Agreement Mr. Worley provided a brief report on the draft Processors Wastewater Treatment Agreement (Processors WTA) including the total cost of the overall Process Wastewater Reuse Facility{PWRF}project for all phases. He described the options to reduce that overall cost. Council and Mr. Worley continued discussion regarding options to reduce the o�erall cost. Ms. Roach requested that the Executive Session be conducted next instead of at the end as presented on the agenda. Mayor Barajas asked for a Roll Call vote after Ms. Roach moved and Mr. Campos seconded the motion to move into Executive Session. He stated that the concerns of the property owner may be addressed administratively. However, Council will need to hold a new public hearing and it must be properly noticed before final action may occur. Single Room Occupancy (SRO) Housing Moratorium Mr. White provided a brief report on the status of the moratorium of the Single Room Occupancy, noting that status of the current SRO projects within Tri-Cities (Pasco, Kennewick and Richland). Council and Mr. White briefly discussed the con#inuation of the moratorium of the SROs until the Housing Capacity Plan is completed. Resolution -Agreements for the Purchase of Virtual Desktop Infrastructure Mr. Rice provided a brief overview of the purchase agreements for the needed Virtual Desktop Infrastructure (VDI). Presentation - Land Mobile Radia (LMR) to Cellular (LT�) Radio Interface Infrastructure , Fire Chief Gear introduced Deputy Fire Chief Patrick Reid and Brad Steiner, ATT/FirstNet Engineer who provided a brief report on the need for updating emergency services communications equipment. MISCELLANEOUS COUNCIL DISCUSSION Mr. Worley invited Council to Road 76 fundraising event scheduled for Saturday, February 18, 2023.
