AN ORDINANCE OF THE CITY OF PASCO, WASHINGTON, TO
ESTABLISH DOWNTOWN LAND USE AND AMEND THE PASCO
MUNICIPAL CODE CHAPTER 25.95 "CENTRAL BUSINESS OVERLAY
DISTRICT", RELATED TO 2022 COMPREHENSIVE PLAN DOCKET AND
THE DOWNTOWN PASCO MASTER PLAN.
WHEREAS, the Downtown Pasco Master Plan was adopted in January 2022 and included
strategies to improve the quality of life and business environment through identifying strategic
investments, policies, and implementation steps to help foster a thriving Downtown; and
WHEREAS, Economic Development Policy 4-C of the 2018-2038 Pasco Comprehensive
Plan seeks to pursue the ongoing revitalization of Downtown Pasco including incentivizing
development in the Central Business District, and following the Main Street approach; and
WHEREAS, the creation of the Downtown Pasco Overlay District establishes the
necessary framework to carry out the recommendations of the Downtown Pasco Master Plan.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. That Chapter 25.95 entitled "Central Business Overlay District" of the
Pasco Municipal Code shall be and hereby is amended and shall read as follows:

The puKpose of the Downtown Pasco Overlay District is to encoura Je infill
development, redevelopment, and re -investment in areas with existing
infrastructure investments as a means of achieving balanced growth, efficient land
use and cost-effective delivery of public services. The Downtown Pasco Overlay
District shall enhance and reflect Pasco's history, people, and culture. [Ord. 3514
§ 8, 2001; Code 1970 § 25.45.010.]
25.95.012 Objectives.
The obiectives of the Downtown Pasco Overlay District are:
(1) Provide development regulations and design standard_ s that are tailored to
the Downtown and surrounding neighborhoods that align with the Downtown
Pasco Master Plan Vision.
(2) Accommodate :growth within the downtown area by encouraging, and
facilitating new development on vacant, byl2assed and underutilized land within
areas that already have infrastructure, utilities, and public facilities.
(3) Allow and encourage a mixed -use pattern of development in the downtown
area.
4 Create a balanced distribution of land uses including shol2s, workplaces,
civic buildings, entertainment uses, and residences that satisfy market_ demand
within the downtown area.
(5) Provide an environment that promotes safe pedestrian access and
connections between developments, more pedestrian -scale amenities, and an
identifiable downtown core area.
25.95.020 Applicability.

The Downtown Overlay District shall apply to those lands within or abutting

25.95.030 Use in combination.
This chapter shall be used in addition to and in combination with all other district
and development regulations contained in this title as they apply to the lands

described in PMC 25.95.020. The requirements of this chapter shall take
precedence over the requirements of the underlying district regulations. [Ord. 3514

25.95.040 Prohibited uses.
Evidence received by the Planning Commission demonstrated that certain land uses
make the central business area of the City, as defined in PMC 25.95.020, less
desirable or attractive to the public due to a demonstrated history of and
contribution to general public disorder, loitering, nuisance and other acts
detrimental to the public image of the area. Certain other uses do not encourage the
grouping of complementary and compatible uses as envisioned by the
Comprehensive Plan.
The following listed uses, for reasons explained above, inhibit new business
growth, contribute to business loss and decline of property values, inhibit
convenient access to desired businesses, do not foster the complementary grouping
of businesses, or perpetuate a public image which is undesirable or unattractive and
detrimental to public and private investment in business areas, and therefore are
prohibited as follows:
(1) Community service facilities level two as defined in PMC 25.15.050 are
prohibited in all districts within the geographic area described in PMC
25.95.020. [Ord. 3514 § 8, 2001; Code 1970 § 25.45.040.]
25.95.050 Development standards.
In all other respects the underlying standards of the applicable zoning districts shall
apply to land uses with the eentfal business Downtown Pasco Overlay District
ever -lay distfie4.
(1) The Downtown Pasco Overlay District shall be exempt from the following:
(a) Off -Street Parking requirements of PMC 25.185.
b Density threshold requirements of PMC 25.215.015.

Section 2. Severability. If any section, subsection, sentence, clause, phrase or word
of this Ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction,
such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any
other section, subsection, sentence, clause, phrase or word of this Ordinance.
Section 3. Corrections. Upon approval by the city attorney, the city clerk or the code
reviser are authorized to make necessary corrections to this Ordinance, including scrivener's errors

or clerical mistakes; reference to other local, state, or federal laws, rules, or regulations; or
numbering or referencing of Ordinances or their sections and subsections.
Section 4. Effective Date. This Ordinance shall take full force and effect five (5) days
after approval, passage and publication as required by law.
