AN ORDINANCE AMENDING THE 2023-2024 BIENNIAL CAPITAL
PROJECTS BUDGET (ORDINANCE NO. 4620) OF THE CITY OF PASCO,
WASHINGTON, BY PROVIDING SUPPLEMENT THERETO; TO PROVIDE
ADDITIONAL APPROPRIATION IN THE OVERLAY FUND FOR THE
COURT STREET OVERLAY -ROAD 44 TO ROAD 68 AND COURT STREET
OVERLAY - PHASE 2 PROJECTS.
WHEREAS, on November 28, 2022, the Pasco City Council approved Ordinance No.
4620, adopting the 2023-2024 Biennial Capital Projects Budget; and
WHEREAS, the 2023-2024 Biennial Capital Projects Budget included expense
appropriation for the Court Street Overlay-Road 40 to Road 44 in the amount of$1,850,000 and
Court Street Overlay—Phase 2 (N 20th Ave to US 395) Project in the amount of$165,000; and
WHEREAS, the 2023-2024 Biennial Capital Projects Budget included revenue budget to
support Court Street Overlay — Road 44 to Road 68 Project in the amount of$1,573,000 from
grant sources and another$277,000 supported by Overlay Fund Balance.The Court Street Overlay
— Phase 2 (N 20th Ave to US 395) Project was funded from I-182 Traffic Impact Fund in the
amount of$165,000; and
WHEREAS, a budget carryover for the Court Street Overlay -N 20th to US 395 Project
will take place in the amount of$800,000 reducing the need for budget adjustment; and
WHEREAS, the City is approved to receive a National Highway System (NHS) Asset
Management Program Grant for $2,250,000 an increase of $677,000 over budgeted revenue,
funded through the Washington State Department of Transportation for design and construction
of Court Street Overlay - Road 44 to Road 68; and
WHEREAS, said I-182 Traffic Impact Fund is being replaced by the Overlay Fund and
the Court Street Overlay — Phase 2 (N 20th Ave to US 395) Project amended for an additional
$441,602, for a total of 1,518,602.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO,
WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1. Pursuant to RCW 35A.34.200 the City Council finds that it is in the best
interest of the City that the 2023-2024 Biennial Capital Projects Budget be and the same is hereby
amended to provide for the following adjustments to revenues, transfers in, expenditures, and
transfers out by providing authority for any necessary transfer of money within or between funds
indicated, and their subsequent impact to end fund balance:

Section 2. That the additions in appropriations and expenditures are hereby declared
to exist in the above funds for the said uses and purposes as shown above, and the proper City
officials are hereby authorized and directed to issue warrants and transfer funds in accordance
with the provision of the Ordinance.
Section 3. Except as amended herein, Ordinance No. 4620 as previously adopted
heretofore shall remain unchanged.
Section 4. Severability. If any section, subsection, sentence, clause, phrase or word
of this ordinance should be held to the invalid or unconstitutional by a court of competent
jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or
constitutionality of any other section,subsection,sentence,clause phrase or word of this ordinance.
Section 5. Corrections. Upon approval by the city attorney,the city clerk or the code
reviser are authorized to make necessary corrections to this ordinance,including scrivener's errors
or clerical mistakes;reference to other local, state,or feral laws,rules,or regulations;or numbering
or referencing of ordinances or their sections and subsections.
Section 6. Effective Date. This ordinance shall take full force and effect five(5)days
after approval, passage and publication as required by law.
