HomeMy WebLinkAboutMurraysmith aka Consor North America - WWTP Improvements-Phase 2 PSA (#21-029) - Amendment No. 2AMENDMENT NUMBER 2 to PROFESSIONAL SERVICES AGREEMENT WWTP Improvements — Phase 2 Project No. 21237 AGREEMENT NO. 21-029 WHEREAS, the City and Murraysmith, entered into a Professional Services Agreement on 6/18/2021 to provide engineering services with respect to the Wastewater Treatment Plant (WWTP) Improvements project; and WHEREAS as the Phase 2 project progressed Murraysmith and City Staff have identified additional services; and WHEREAS, in order to carry out the intent of providing sufficient professional and design services of the WWTP Improvements project the current Agreement needs to be modified to account for these additional services; and NOW, THEREFORE, this agreement is amended to allow Murraysmith, to provide additional professional and design engineering services as described in Exhibit A. 1. Scottie of Work: See Exhibit A. 2. Fee: The compensation for the additional work is based on a Time & Materials Basis of $95,887.00, increasing the overall total authorization amount to $2,470,170.00. Time ofperformance: No Change. CITY OF PASCO: CONSULTANT City of Pasco Murray mith Dave Zabell, City Manager Craig Anderson, PE, Principal Amendment No. 2 to Professional Services Agreement Murraysmith WWTP Improvements — Phase 2 Page 1 SCOPE OF WORK — AMENDMENT #2 WWTP IMPROVEMENTS, PHASE 2 CITY OF PASCO, WA Background EXHIBIT A Murraysmith (Consultant) entered into a contract to complete design of the Phase 2 Improvements to the City of Pasco, Washington (City) municipal wastewater treatment plant (WWTP) in June 2021. The design was planned to be complete in July 2022 with bidding through April 2023. Consultant has been asked to revise their original scope of work to the City and this Amendment clarifies and expands the services to be completed. The following Scope of Services describes the changes that were made. All work is still for the design of the Phase 2 improvements only. Scope of Services The following subtasks from the January 2021 original contract and Amendment #1 have been modified per this amendment. The previous scope of services description for each is deleted per this contract amendment. All other tasks and subtasks remain unchanged. ■ Subtask 5.7 — Development of Final Contract Documents The following subtasks are new tasks per this amendment. ■ Subtask 8.5K — Permitting Task Weekly Manager Meetings ■ Subtask 8.51-- United States Coast Guard Support ■ Subtask 8.5M — Department of Natural Resources Support ■ Subtask 8.5N — Biological Assessment and Opinion Support The following new subtask scope of services descriptions are added per this contract amendment. Task 5 — Contract Document Development 5.7A WWTP Development of Final Contract Documents Following receipt of the review comments, Consultant will incorporate them, as appropriate, and prepare a final stamped set of Contract Documents ready for Ecology formal approval and subsequent Contractor bidding. 100% Contract Documents will be updated and modified to include additional contract clauses and inserts to meet the Build America Buy, American Act requirements. Writing of BABA Act Waiver for specialized equipment that does not meet the Act. City of Pasco MURRAYSMITH WWTP Improvements, Phase 2 August 2022 1 5.78 Outfall Development of Final Contract Documents Following receipt of the review comments, Consultant will incorporate them, as appropriate, and prepare a final stamped set of Contract Documents ready for Ecology formal approval and subsequent Contractor bidding. 100% Contract Documents will be updated and modified to include additional contract clauses and inserts to meet the Build America Buy, American Act requirements. Hold a meeting with Washington Department of Ecology to discuss the need for and eliminate the need for a post construction dye study. Submit a mixing zone update letter regarding recommended Pasco multiport diffuser location conditions. Submit Design Update Technical Memo explaining the change of the pipeline alignment compared to the modeling work completed to date including description of modelling, alignment and effect on the dilution factors and design of the multiport diffuser. Deliverables ■ Mixing Zone Update Letter ■ Design Update Technical Memo Assumptions ■ New model runs are not needed Task 8 — Special Activities & Investigations 8.5K Permitting Task Weekly Manager Meetings Weekly Permitting Task meetings will be held to review the project and Permitting Task status, introduce new team members to the facility and the City, establish project goals and objectives, review communication protocols, and discuss the project scope and schedule. Deliverables ■ None 8.5M Department of Natural Resources Support Work within the pre-McNarry pool, below the old ordinary high water level of the Columbia River requires coordination with the Department of Natural Resources (DNR). DNR has provided their ten item "needs list" which will be incorporated into the contract documents. Coordinate with the DNR review process to obtain agency feedback, and to answer agency questions, respond to comments, and track review status. Deliverables ■ None 8.5N Biological Assessment and Opinion Support This modification provides additional scope and budget to supplement the original Biological Assessment task, which was substantially completed with the USACE's acceptance of the biological assessment document and the transmittal of that document to NMFS and USFWS to initiate the Section 7 Endangered Species Act consultation process. The scope and budget additions are the result of subsequent coordination with NMFS on their review of the project and their schedule for issuing a written biological opinion, which is needed to conclude the consultation process. The scope and budget additions will provide NMFS with additional information on water quality of the WWTP discharge and additional analysis/documentation of the potential for WWTP operation to impact listed salmon and steelhead. Existing information will be reviewed for WWTP effluent water quality, Columbia River water quality, NPDES permit conditions and relevant information, and analysis on anticipated listed species impacts in a supplement to the biological assessment. The supplemental document will contain key information requested by NMFS, including an evaluation of species responses and long-term habitat exposure to reduced water quality. The document will be formatted using NMFS-authored biological opinions as guidance. The primary purpose of providing NMFS this additional documentation in this format is to accelerate the NMFS review timeline to meet project schedules, allowing NMFS to issue a "condensed" biological opinion that references the supplemental document prepared with this scope amendment. The relevant information will be available from a prior Tier II Water Quality and Anti -Degradation Study (Murraysmith, 2019) and from mixing zone study work completed for the proposed outfall. No additional water quality monitoring is proposed or expected to be needed for this work. ■ Based on coordination with NMFS, the "action area" for studying water quality -related effects of the WWTP operation and discharge will extend from the discharge point in the Columbia River downstream to the confluence with the Snake River, beyond which the potential for effects is expected to be negligible. • The work covered under this scope will be billed on a time and materials basis at the billing rates for personnel working directly on the project, which will be made at the Consultant's current Hourly Rates, plus Direct Expenses incurred. The overall budget estimate breakdown forthis work is outlined in the table below. Consultant will manage the work identified to the aggregate authorized budget amount which shall not be exceeded without prior written authorization from the City.
