HomeMy WebLinkAbout4643 Ordinance - Amend PMC 2.05 Related to Regular Meetings and Workshops ORDINANCE NO. 4643 AN ORDINANCE OF THE CITY OF PASCO, AMENDING PASCO MUNICIPAL CODE, CHAPTER 2.05 "CITY COUNCIL" RELATED TO UPDATES TO THE WASHINGTON STATE OPEN PUBLIC MEETINGS ACT EFFECTING CITY COUNCIL'S CONDUCT OF BUSINESS, AND INCLUDES OTHER MINOR HOUSEKEEPING UPDATES WITHIN THE SAME CHAPTER. WHEREAS, the Washington State Legislature has amended the Open Public Meetings Act (OPMA) related to locations of ineetings, remote meeting attendance by members of the legislative body, online posting of regular meeting agendas, posting of special meeting notices, receiving public comments,recording meetings,announcing the purpose of executive sessions and the adjournment of in-person meetings; and WHEREAS, some of the OPMA amendments were effective upon Governor Inslee's signature of House Bill (HB)-1329 on March 24, 2022,while other amendments became effective June 9, 2022; and WHEREAS, to meet the new OPMA requirements, the City of Pasco Council (Council) needs to amend the Pasco Municipal Code (PMC) Chapter 2.05 "City Council"related to regular and special meetings, remote meeting attendance of Councilmembers, and receiving public comments; and WHEREAS, the other amendments within the OPMA are procedural in nature and were addressed through the appropriate staff to ensure compliance is met including locations of meetings,online posting of regular meeting agendas,posting of special meeting notices,recording meetings, announcing the purpose of executive sessions and the remote access to meetings; and WHEREAS, a housekeeping amendment is to include a new section for City Council's workshop meetings within the PMC. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. The Mayor and the members of the City Council shall be reimbursed for actual expenses incurred in the discharge of their official duties upon the presentation of a claim therefor and after allowance and approval thereof by the City Council. The City Clerk shall prepare the minutes of all regular ;, and special City Council meetings.A copy of the minutes shall be prepared for approval of the City Council at its next regular business meeting. The minutes need not be read in open meeting except that on motion of the Council, the minutes of any previous meeting may be read in full. All such items on the consent agenda shall be voted on at one time by one roll call vote. An Councilmember intendin�to utilize Remote Attendance for a meeting shall vrovide ample notice prior to the scheduled meetin�;of such intent to the Ma�or and/or Citv Mana�er to allow time for staff to setup the required equipment prior to the specified meetin�.The use of virtual platform ec}uipment shall allow Councilmember s to full artici ate in the meetin allow the official minute recordin 7 s�taff person to observe all activitv, allow the recordin�vstem to ca�ture, in open session, all activity and discussiont and allow the Councilmembers and the public to adequatelv see and hear the meetin� proceedin,�s includin� all discussion, comments, and anv voting bv the Councilmember attendin�remotel_y. 2) Durin = an meetin a Councilmember is in Remote Attendance, the Mavor or presidin�, officer shall state for the record that a particular Councilmember is attendin�with Remote Attendance. 3) Anv Councilmember utilizing Remote Attendance shall bear the risk that the virtual platform bein� used to effectuate the Remote Attendance mav malfunction or otherwise fail to o erate ro erl in a manner which effectivel prevents the Councilmember's attendance and t�artic•ipation at the meetin�.
