Resolution No. 4232 - Setting Public Hearing for Tri -Cities Animal Shelter
Right -of -Way Vacation (VAC 2022-005)
To approve Resolution No. 4232, setting 7;00 PM, Monday, October 3, 2022, as
the time and date for a public hearing to consider the vacation of portions of Court
Street and Lena Street in Block 10 of Oakley's Riverfront Addition to Pasco.
Resolution No. 4233 - Process Water Reuse Facility (PWRF) Work
Acceleration Agreement with Burnham SEV
To approve Resolution No. 4233, authorizing the City Manager to execute a Work
Acceleration Agreement and to allow minor substantive changes with Burnham
SEV Pasco, LLC. for the Anaerobic Digestion and Renewable Natural Gas Project,
related to the Process Water Reuse Facility, Phase 3 Project.
Resolution No. 4234 - Amendment to 1-182/Broadmoor Interchange
Improvement Contract with DKS for Final Design
To approve Resolution No. 4234, authorizing the City Manager to execute
Amendment No. 2 to the Professional Services Agreement with DKS Associates,
Inc. for the Broadmoor and 1-182 Interchange Project.
Resolutions Nos. 4235 to 4240 - Approving Six (6) Project Acceptances for
Burns Rd Pathway Ph 1 -3; North Rd 93/Powerline Pathway; Maple Dr. Water
Main; and Signage & Striping Burden Blvd Projects
To approve Resolution No. 4235, accepting work performed by Ellison Earthworks,
LLC., under contract for the Burns Road Pathway - Phase 1 (Rd 100 to Rd 90)
Project.
To approve Resolution No. 4236, accepting work performed by Ellison Earthworks,
LLC., under contract for the Burns Road Pathway - Phase 2 (Rd 90 to Rd 84)
Project.

MOTION: Mayor Pro Tem Maloney moved, seconded by Councilmember
Campos to approve the Consent Agenda as read.
RESULT: Motion carried unanimously 7-0

VISITORS - OTHER THAN AGENDA ITEMS
Susanne Ayala, downtown Pasco business owner, expressed appreciation to the City
of Pasco for helping her and her husband ready the alley next to their restaurant Ciao
for their upcoming weekend event.
Ericka Taranto, Pasco resident, posed two questions to Council related to a Code
Enforcement issue requiring solid waste (garbage) service and BDI is her only option.
She provided City Clerk Barham her email address in order for staff to provide answers
to her questions.
Leo Morales, Pasco resident and downtown Pasco business owner, commented on the
closing of his business in the downtown area.
Dwight Hass, Pasco resident, expressed opposition to Comprehensive Plan
Amendment application for the River Haven neighborhood.
Cindy Hewett, Pasco resident, commented on the Burlington Northern Railroad
property that continues to be problem with trash and a fire hazard. She submitted a
letter of with neighbors signatures to City Clerk Barham requesting that the City help
get that area cleaned up and the dead tree be removed.
Diane Johnson, Pasco resident, commented on the problem with loud activity at the
carwash located on Burden Boulevard and Convention, as well as the destruction of
private property located next to the carwash.
Thomas Granbois, Pasco resident, expressed appreciation to the City of Pasco for the
efforts made to clean up the downtown area.

Russell Glatt, Pasco resident, commented on the Pasco downtown area from the 1970s
forward, expressed appreciation to the City for the recent improvements to the
downtown area and he expressed opposition to retail cannabis.
Ashley Adkins, Pasco resident, corner lot fencing issue and asked that action be taken
on it.
David Morgan, Pasco resident, announced a meeting scheduled in Spokane, WA with
a City of Spokane Councilmember and Police staff on Friday, September 16, 2022 and
Council may join it via Skype.
REPORTS FROM COMMITTEES AND/OR OFFICERS
Verbal Reports from Councilmembers
Mr. Brown commented a "Back to School' event that he recently attended.
Mr. Campos commented on the Citizens of Lakeview, Pasco meeting he recently
attended.
HEARINGS AND COUNCIL ACTION ON ORDINANCES AND RESOLUTIONS
RELATING THERETO
Public Hearing - 2022 Comprehensive Plan Amendments (Docket)
Mayor Barajas explained the process for the scheduled public hearing and criteria
for setting the 2022 Comprehensive Plan Amendments docket.
Mr. White confirmed the process Mayor Barajas explained came directly from the
Washington State Administrative Code (WAC). He noted that staff recommends
that all applications be placed on the docket.
Mayor Pro Tem Maloney and Mr. Serrano commented on application CPA2022-
012 and expressed concern that it did not meet criteria No. 4 and No. 3
respectively, and it should be removed from the docket.
Council continued discussing application CPA2022-012.
Mayor Barajas declared the Public Hearing open to consider the proposed
applications for the 2022 Comprehensive Plan Amendments.
Brad Peck, Pasco resident, expressed opposition to application CPA2022-012,
Riverview area.
Alecia Greenway, Pasco resident, expressed opposition to application CPA2022-
012, Riverview area.

and she submitted a list of signatures that concur to City Clerk Barham
Mayor Barajas read that Tom Van Dorn and D. Hans had submitted written
comments to the City Clerk's Office expressing opposition to application CPA2022-
012.
Huston Willard, developer, expressed support for application CPA2022-012.
Debra Peck, Pasco resident, expressed opposition to application CPA2022-012.
Aaron Beasley, Pasco resident and property owner, expressed support for
application CPA2022-012.
Denice Pearson, Pasco resident, expressed opposition to application CPA2022-
012.
Lionell Singleton, developer, expressed support for application CPA2022-012.
Shane O'Neill, Pasco resident and consultant for applicant, expressed support for
application CPA2022-012.
Ray Salinas, Pasco resident, expressed opposition to application CPA2022-012.
Erin Roba, Pasco resident, expressed opposition to application CPA2022-012.
Pete Harpster, consultant for applicant, expressed support for application
CPA2022-006
Rick Simon, RPS Planning and consultant for applicant, expressed support for
application CPA2022-001.

Following three calls for additional comments, and there being none, Mayor Barajas
declared the Public Hearing closed.
Mr. Ferguson explained that the resolution to set the 2022 Comprehensive Plan
Amendments will come back for Council action at their next business meeting
scheduled for September 19, 2022.

Council discussion ensued on the 2022 Comprehensive Plan Amendments
applications with staff and there was a consensus to remove application CPA2022-
012 from consideration when setting the docket..
Mr. Serrano expressed concerns regarding application CPA2022-007
Mr. Maloney and Mr. Serrano recommended to include application CPA2022-010
when setting the docket.
RECESS
Mayor Barajas called a five-minute recess at 8:40 PM.
CONTINUATION OF HEARINGS AND COUNCIL ACTION ON ORDINANCES AND
RESOLUTIONS RELATING THERETO
Public Hearing & Resolution No. 4241 - Single Room Occupancy (SRO)
Housing Moratorium
Mr. White provided a brief report related to the SRO moratorium.
Mayor Barajas declared the Public Hearing open to consider the proposed
continuation of the SRO moratorium.
Following three calls for comments, and there being none, Mayor Barajas declared
the Public Hearing closed.
MOTION: Mayor Pro Tem Maloney moved, seconded by Councilmember
Serrano to approve Resolution No. 4241, continuing the moratorium,
established through Resolution No. 4158, prohibiting the permitting of Single
Room Occupancy housing and conversion thereto in the City of Pasco, pending
study of impacts and best development practices and policy.
RESULT: Motion carried unanimously 7-0

ORDINANCES AND RESOLUTIONS NOT RELATING TO HEARINGS
Public Meeting & Resolution No. 4242 - Accepting a Notice of Intent for
Alford/Cole Annexation (ANX 2022-003)
Mr. White provided a brief report on the request to annex into the City of Pasco and
noted that three petitions for annexation in the same area were just received earlier
in the day.

Mr. Ferguson commented on the required to hold a meeting with the applicants of
the requested annexation.
Mayor Barajas declared the Public Meeting open to consider the proposed
Alford/Cole annexation.
Following three calls for comments, and there being none, Mayor Barajas declared
the Public Hearing closed.
MOTION: Mayor Pro Tem Maloney moved, seconded by Councilmember Milne
to approve Resolution No. 4242, accepting a notice of intent to commence
annexation proceedings for the Alford/Cole annexation, providing a
determination on the boundary to be annexed, and whether simultaneous zoning
and the assumption of bonded indebtedness will be required.
RESULT: Motion carried unanimously 7-0

Ordinance No. 4606 — Amending the Pasco Municipal Code by Creating a new
Section to Align with State Laws and Amending Title 9, Related to Crimes of
Domestic Violence and Violations of Other Court Orders
Mr. Ferguson provided a brief report on the required amendments to the Pasco
Municipal Code (PMC) related to crimes of domestic violence and violation of no
contact court orders. Next he introduced the City of Pasco's Prosecuting Attorney
Mike Rio further explained the need to make the PMC amendments.
Council and Mr. Rio held a brief question and answer period.
MOTION: Mayor Pro Tem Maloney moved, seconded by Councilmember
Serrano to adopt Ordinance No. 4606, creating a new Section 1.02.030 of the
Pasco Municipal Code (PMC), and amending PMC Sections 9.10.030, 9.10.040,
9.15.040, 9.15.050, 9.20.050, 9.20.060 and 9.20.090, updating criminal codes
to address changes in state law involving crimes of domestic violence and
violation of court orders.
RESULT: Motion carried unanimously 7-0

Resolution No. 4243 - Surplus of City Property Along West A Street (Parcel
No. 112282138)
Mr. Ratkai provided a brief report on the surplus of City -owned property.

MOTION: Mayor Pro Tem Maloney moved, seconded by Councilmember Brown
to approve Resolution No.4243, declaring City -owned real property surplus,
setting the minimum price and the method of sale for Parcel No. 112282138, and
further, authorize the City Manager to sell the property through realtor listing for
a minimum price determined through market analysis.
RESULT: Motion carried unanimously 7-0

Resolution No. 4244 - Sale of Property Along West A Street (Parcel No.
112282138)
Mr. Ratkai provided a brief report on the proposed sale of City -owned property.
MOTION: Mayor Pro Tem Maloney moved, seconded by Councilmember Milne
to approve Resolution No. 4244, approving the sale of City -owned real property.
0.8 -acre, located along West A Street.
RESULT: Motion carried unanimously 7-0

MISCELLANEOUS DISCUSSION
Mr. Zabell requested two Councilmembers to sit on the Basin Disposal, Inc. (BDI) Rate
Increase Subcommittee. Mr. Serrano and Mr. Brown volunteered to participate on the
subcommittee.
Mr. Zabell announced upcoming Ciao Trattoria outdoor event and described the
process they went through to obtain a one-time use permit and the City is modeling this
as a pilot project for use of ARPA funding.
Mr. Zabell asked for consensus from Council whether two to three listening sessions
for the retail cannabis issue would be needed and he reiterated the criteria for the
consideration of retail cannabis. Council discussed merits of the listening sessions and
the need to advertise it widely. Council determined that two listening sessions would
suffice, one in King City area and the other in the Roads 68-100 and north of 1-182
corridor.
Lastly, Mr. Zabell announced that the topic of redistricting of Council's Voting Districts
was scheduled for September 26, 2022, Workshop to provide Council a status of the
mapping currently underway and the next steps in the process of redistricting Council's

six Voting Districts. He noted that the approval of the final map has a Mid -November
deadline.
EXECUTIVE SESSION
The scheduled executive session was cancelled.
